 Parsha Shoftim

 

 

As a Rabbi I sometimes feel bad in the limited amount of time I have in a week that I have to cut a Mitzvah or two or some nice words or explanations but not this week. We are continuing with the 2nd Drasha of Moshe Rabbaynu in Devarim. The review and for us new Mitzvos for this Parsha is good for a Rabbi who wants to make a book like Sefer HaChinuch that deals with all the 613 Mitzvos but impossible both for the Rabbi and the general population to cover thoroughly every Mitzvah. So whatever I write this week, I finish with a clear conscience as I have no choice but to leave out between a dozen and a few dozen Mitzvos.

 

16:18 Judges and officers shalt thou make thee in all thy gates, which the LORD thy God giveth thee, tribe by tribe; and they shall judge the people with righteous judgment. 19 Thou shalt not wrest judgment; thou shalt not respect persons; neither shalt thou take a gift; for a gift doth blind the eyes of the wise, and pervert the words of the righteous. 20 Justice, justice shalt thou follow, that thou may live, and inherit the land which the LORD thy God gives thee. 

 

The Gemara brings down the story of sister of Rabban Gamliel and the Rabbi. They went before a non-Jewish Judge from Rome on a dispute. She gave the Judge a lamp and he gave the judge a donkey. The dispute was stated and she said may your ruling enlighten us hinting of the bribe and he said let your ruling ride forth. Afterwards he said that his donkey came and kicked over her lamp. From this dispute they wanted the Jews of Eretz Yisrael only to use a Rabbinical Judge. That was good for their generation when Judges were very G-D fearing. Nowadays, we have a weak generation and very few are truly G-D fearing and analyze the situation correctly.

 

21 Thou shalt not plant thee an Asherah of any kind of tree beside the altar of the LORD thy God, which thou shalt make thee. 

 

What can be an Asherah? The country of Israel is quite dry and sometimes a tree is able to grow by a source of water like in the Arava Desert (Between the Dead Sea and Eilat). The ancient Goyim were impressed by this tree that probably grew in an area where there was some water source all year around. It did not take long for superstitious ignoramuses to make it into a god. It is like the painting of some character in the church of the Nativity where eyes of the character are drawn where the water drips from the column is very rainy years. So the eyes of the character weep. However, the truth is that the building was built and the eyes of so and so were drawn in one rainy year.  

 

22 Neither shalt thou set thee up a pillar, which the LORD thy God hates.

 

This is not a border marker that Yacov and Lavan set up or a foundation stone of the Temple that Yacov set up after his dream of the angels rising and descending the stairs. Rather it was a ‘Mercury’ place that travels on the way would add a stone when they journeyed for good luck.

 

17:1 Thou shalt not sacrifice unto the LORD thy God an ox, or a sheep, wherein is a blemish, even any evil thing; for that is an abomination unto the LORD thy God. 

 

There are cheapskates in this world when it comes to spending upon myself I am that way but large with my family especially my wife. I want to give my children a nice inheritance. However, one must remember that his Panosa comes from HASHEM and there is no place for being stingy towards the source of your income.

 

2 If there be found in the midst of thee, within any of thy gates which the LORD thy God gives thee, man or woman, that does that which is evil in the sight of the LORD thy God, in transgressing His covenant, 3 and hath gone and served other gods, and worshipped them, or the sun, or the moon, or any of the host of heaven, which I have commanded not; 4 and it be told thee, and thou hear it, then shalt thou inquire diligently, and, behold, if it be true, and the thing certain, that such abomination is wrought in Israel; 5 then shalt thou bring forth that man or that woman, who have done this evil thing, unto thy gates, even the man or the woman; and thou shalt stone them with stones, that they die. 6 At the mouth of two witnesses, or three witnesses, shall he that is to die be put to death; at the mouth of one witness he shall not be put to death. 7 The hand of the witnesses shall be first upon him to put him to death, and afterward the hand of all the people. So thou shalt put away the evil from the midst of thee. 

 

There can never-ever be one witness but two so it is not a he said – she said situation but a clear cut case especially here with a capital crime where the witness must through the first stone(s).

 

8 If there arise a matter too hard for thee in judgment, between blood and blood, between plea and plea, and between stroke and stroke, even matters of controversy within thy gates; then shalt thou arise, and get thee up unto the place which the LORD thy God shall choose. 9 And thou shall come unto the priests the Levites, and unto the judge that shall be in those days; and thou shalt inquire; and they shall declare unto thee the sentence of judgment. 10 And thou shalt do according to the tenor of the sentence, which they shall declare unto thee from that place which the LORD shall choose; and thou shalt observe to do according to all that they shall teach thee. 11 According to the law which they shall teach thee, and according to the judgment which they shall tell thee, thou shalt do; thou shalt not turn aside from the sentence which they shall declare unto thee, to the right hand, nor to the left. 12 And the man that doeth presumptuously, in not hearkening unto the priest that stands to minister there before the LORD thy God, or unto the judge, even that man shall die; and thou shalt exterminate the evil from Israel. 13 And all the people shall hear, and fear, and do no more presumptuously. 14 When thou art come unto the land which the LORD thy God gives thee, and shalt possess it, and shalt dwell therein; and shalt say: 'I will set a king over me, like all the nations that are round about me'; 

 

We return again to the holiness of the land that will vomit the evil out in time if we won’t. For in the case of the Temples, the good were vomited out with the bad as a Gezaira had been ordained. This could have been avoided with swift and righteous judgement.

 

15 thou shalt in any wise set him king over thee, whom the LORD thy God shall choose; one from among thy brethren shalt thou set king over thee; thou may not put a foreigner over thee, who is not thy brother. 16 Only he shall not multiply horses to himself, nor cause the people to return to Egypt, to the end that he should multiply horses; forasmuch as the LORD hath said unto you: 'Ye shall henceforth return no more that way.' 17 Neither shall he multiply wives to himself, that his heart turn not away; neither shall he greatly multiply to himself silver and gold. 18 And it shall be, when he sits upon the throne of his kingdom, that he shall write him a copy of this law in a book, out of that which is before the priests the Levites. 19 And it shall be with him, and he shall read therein all the days of his life; that he may learn to fear the LORD his God, to keep all the words of this law and these statutes, to do them; 20 that his heart be not lifted up above his brethren, and that he turns not aside from the commandment, to the right hand, or to the left; to the end that he may prolong his days in his kingdom, he and his children, in the midst of Israel.

 

There will come a time after Moshe, Yoshua and the Shoftim that the people will need a central government and a king. He shall not be like other kings with too many horses or cars at his service. He shall have no more than 18 wives and preferably much less – Sanhedrin bases on the number of wives David had.

 

18:1 The priests the Levites, even all the tribe of Levi, shall have no portion nor inheritance with Israel; they shall eat the offerings of the LORD made by fire, and His inheritance. 2 And they shall have no inheritance among their brethren; the LORD is their inheritance, as He hath spoken unto them. 

 

They are limited to living in cities and supplied Teruma or Maaseh. They can become teachers, or the Cohanim even skin doctors based on the laws of Negaim with the various discolorations on the body.

 

3 And this shall be the priests' due from the people, from them that offer a sacrifice, whether it be ox or sheep, that they shall give unto the priest the shoulder, and the two cheeks, and the maw. 4 The first-fruits of thy corn, of thy wine, and of thine oil, and the first of the fleece of thy sheep, shalt thou give him. 5 For the LORD thy God hath chosen him out of all thy tribes, to stand to minister in the name of the LORD, him and his sons forever. 

 

This is the priest’s due of animals and is over-come nowadays by making a Cohain a partner also for the Bechor of an animal born.

 

6 And if a Levite come from any of thy gates out of all Israel, where he sojourns and come with all the desire of his soul unto the place which the LORD shall choose; 7 then he shall minister in the name of the LORD his God, as all his brethren the Levites do, who stand there before the LORD. 8 They shall have like portions to eat, beside that which is his due according to the fathers' houses. 

 

You are supposed to give Maaser the Levi. Obviously, if your uncle is a Levi give him, if you have more than enough a Levi or two on your block or in your area.

 

9 When thou art come into the land which the LORD thy God giveth thee, thou shalt not learn to do after the abominations of those nations. 10 There shall not be found among you any one that makes his son or his daughter to pass through the fire, one that uses divination, a soothsayer, or an enchanter, or a sorcerer, 11 or a charmer, or one that consults a ghost or a familiar spirit, or a necromancer. 

 

These actions are forbidden like séances, etc. the reason is: 12 For whosoever doeth these things is an abomination unto the LORD; and because of these abominations the LORD thy God is driving them out from before thee. 

 

So therefore we don’t play with fire and do these horrible things.

 

15 A prophet will the LORD thy God raise up unto thee, from the midst of thee, of thy brethren, like unto me; unto him ye shall hearken; 16 according to all that thou didst desire of the LORD thy God in Horev in the day of the assembly, saying: 'Let me not hear again the voice of the LORD my God, neither let me see this great fire any more, that I die not.' 17 And the LORD said unto me: 'They have well said that which they have spoken. 18 I will raise them up a prophet from among their brethren, like unto thee; and I will put My words in his mouth, and he shall speak unto them all that I shall command him. 19 And it shall come to pass, that whosoever will not hearken unto My words which he shall speak in My name, I will require it of him. 

 

Now how do I know the difference between a true prophet and the television preacher who said twice, “G-D will take me if I don’t raise another million for this megachurch. If you feel inside that you have fear of the L-RD and Mussar from the prophecy. Example: He should receive from your Maaser. Example: Zechariah: “On that day the L-RD shall be ONE and HIS NAME ONE” then it is true. If you are uncertain then consult a Ruv.

 

20 But the prophet, that shall speak a word presumptuously in My name, which I have not commanded him to speak, or that shall speak in the name of other gods, that same prophet shall die.' 21 And if thou say in thy heart: 'How shall we know the word which the LORD hath not spoken?' 22 When a prophet speaks in the name of the LORD, if the thing follow not, nor come to pass, that is the thing which the LORD hath not spoken; the prophet hath spoken it presumptuously, thou shalt not be afraid of him. 

 

If the prophet says that the Moshiach is coming on the 18th of Elul wait and check it out but if he said the 4th of Elul and it passed and no Moshiach he is false. For the good from the L-RD shall not be disturbed. However, if he warns of war, plague or something bad and the people do Teshuva and give Tzeduka then if it does not come to pass, that is because we have repented and he still could be a true prophet.

 

19:1 When the LORD thy God shall cut off the nations, whose land the LORD thy God gives thee, and thou dost succeed them, and dwell in their cities, and in their houses; 2 thou shalt separate three cities for thee in the midst of thy land, which the LORD thy GOD giveth thee to possess it. 3 Thou shalt prepare thee the way, and divide the borders of thy land, which the LORD thy God causes thee to inherit, into three parts, that every manslayer may flee thither. 

 

The three cities on the other side of the Yarden had been chosen already.

 

15 One witness shall not rise up against a man for any iniquity, or for any sin, in any sin that he sins; at the mouth of two witnesses, or at the mouth of three witnesses, shall a matter be established. 16 If an unrighteous witness rise up against any man to bear perverted witness against him; 17 then both the men, between whom the controversy is, shall stand before the LORD, before the priests and the judges that shall be in those days. 18 And the judges shall inquire diligently; and, behold, if the witness be a false witness, and hath testified falsely against his brother; 19 then shall ye do unto him, as he had purposed to do unto his brother; so shalt thou put away the evil from the midst of thee. 20 And those that remain shall hear, and fear, and shall henceforth commit no more any such evil in the midst of thee. 21 And thine eye shall not pity: life for life, eye for eye, tooth for tooth, hand for hand, foot for foot. 

 

You need to have two witnesses to clarify to make the case or if one witness or a close family member it is thrown out.

 

20:1 When thou go forth to battle against thine enemies, and seest horses, and chariots, and a people more than thou, thou shalt not be afraid of them; for the LORD thy God is with thee, who brought thee up out of the land of Egypt. 2 And it shall be, when ye draw nigh unto the battle, that the priest shall approach and speak unto the people, 

 

To weed out sinners (including people who talk in the middle of prayer) or those who fear man more than they fear G-D

 

…19 When thou shalt besiege a city a long time, in making war against it to take it, thou shalt not destroy the trees thereof by wielding an axe against them; for thou may eat of them, but thou shalt not cut them down; for is the tree of the field man, that it should be besieged of thee? 20 Only the trees of which thou know that they are not trees for food, them thou may destroy and cut down, that thou may build bulwarks against the city that makes war with thee, until it fall.

 

G-D has mercy upon trees and fruits all the more so mankind that was made in HIS Image.

 

21:1 If one be found slain in the land which the LORD thy God giveth thee to possess it, lying in the field, and it be not known who hath smitten him; 2 then thy elders and thy judges shall come forth, and they shall measure unto the cities which are round about him that is slain. 3 And it shall be, that the city which is nearest unto the slain man, even the elders of that city shall take a heifer of the herd, which hath not been wrought with, and which hath not drawn in the yoke. 4 And the elders of that city shall bring down the heifer unto a rough valley, which may neither be plowed nor sown, and shall break the heifer's neck there in the valley. 5 And the priests the sons of Levi shall come near--for them the LORD thy God hath chosen to minister unto Him, and to bless in the name of the LORD; and according to their word shall every controversy and every stroke be. 6 And all the elders of that city, who are nearest unto the slain man, shall wash their hands over the heifer whose neck was broken in the valley. 7 And they shall speak and say: 'Our hands have not shed this blood, neither have our eyes seen it. 8 Forgive, O LORD, Thy people Israel, whom Thou hast redeemed, and suffer not innocent blood to remain in the midst of Thy people Israel.' And the blood shall be forgiven them. 9 So shalt thou put away the innocent blood from the midst of thee, when thou shalt do that which is right in the eyes of the LORD.

 

If found between two cities a measurement is taken from the nostril which city is closer. The elders come and they proceed as described here. If the area has hills special ways to measure hills and valleys. Example a person found between Fort Lee NJ and 180th ST in Manhattan on the Bridge that links them together.

Pierre Louis and the Baal Shem Tov by Rabbi Yerachmiel Tilles.

One day, the Baal Shem Tov, founder of the Chasidic movement, summoned Rabbi Nissan. He gave his faithful chasid a closed envelope and asked him to travel to the castle of the local landowner, Count Radzvill. Rabbi Nissan was to open the envelope in two days’ time.

 

The purpose of this trip was to try to arouse the Count's best friend, Pierre-Louis, to return to Judaism. Rabbi Nissan was perplexed for, as far as everyone knew, Pierre Louis was not Jewish. Yet, he followed his Rebbe's instructions without question.

 

Count Radzvill was kind and just to all those living on his lands, Jew and gentile alike. On the particular day that Rabbi Nissan arrived at the castle, Count Radzvill and Pierre Louis had just returned from a two-month holiday in Europe. Crowds of people were gathered to welcome them back.

 

After the two men entered the castle and the crowd had dispersed, Rabbi Nissan meandered around the grounds for the rest of the day wondering how he could arrange to speak to Pierre Louis. When night came, Rabbi Nissan travelled into town and slept in the local synagogue.

 

Early the next morning, Rabbi Nissan returned to the castle hoping to be inspired as to how he could obtain an audience with Pierre Louis. But as he approached the castle, Rabbi Nissan immediately noticed that something was wrong. A large crowd was gathered there, but many of them were crying.

 

Rabbi Nissan inquired and found out what had transpired. The Count and Pierre Louis had gone hunting late the night before. When they returned from their successful trip, a tragic accident occurred. The Count tripped on one of the castle steps, his pistol discharged and he suffered a large bleeding wound in his chest.

 

Despite the attention of the best doctors, all efforts to stop the bleeding had not helped. The Count was dying.

 

That's when Rabbi Nissan remembered the envelope the Rebbe had given him. He opened it, took out the letter and began reading. It was a prescription with exact directions how to prepare a salve to cure...a gunshot wound to the chest!

 

Rabbi Nissan ran to the castle gate waving the letter and demanded to be let in, but the guards refused. Pierre Louis heard the noise from inside the palace and ran out to the gate, obviously irritated, "Jew! What do you want here?" he shouted. "Don't tell me you are a doctor? Leave here immediately!

 

"Wait!" he shouted even louder. "What is that paper you are holding?"

 

Rabbi Nissan tried to explain, but the Frenchman snatched the prescription from his hand and began to read. "This is your cure?!" He screamed. "This is nonsense!"

 

He was about to tear it into pieces when one of the doctors emerged from the castle, noticed the commotion and approached. He examined the paper, turned to face Pierre Louis with his back to the Jew and whispered. "They've given up in there. Let the Jew try; it can't hurt."

 

Minutes later Rabbi Nissan was in the castle, preparing the medicine. Then he began the treatment. Some of it he smeared on the wound, and some of it he applied on various parts of the Count's body. Every few minutes he repeated the process, following the instructions exactly.

 

To everyone's surprise, the Count stopped hemorrhaging almost immediately! After a few applications he even seemed to be breathing more deeply and evenly. After an hour, instead of being dead as everyone had anticipated, color returned to his cheeks and minutes later he regained consciousness!

 

The doctors and professors were speechless; they had never seen anything even vaguely like it. Pierre Louis, moreover, was moved to the essence of his very being.

 

After several hours the Count was strong enough to call Rabbi Nissan to his bedside and thank him. He offered to reward him but the chasid refused. "Seeing you returned to health is my reward. Just continue to treat the Jews kindly," he said. "But," he added, "I do have one request: I wish to speak with Pierre Louis privately."

 

The bewildered Pierre Louis and Rabbi Nissan went into a side room and closed the door. Rabbi Nissan said, "I am a follower of a great Jew called Rabbi Yisrael Baal Shem Tov. He was the one who wrote that prescription and saved the Count. He told me to come here and tell you to return to Judaism."

 

Pierre was still in shock from the near death of his friend and then his strange supernatural recovery. And now this?

 

Pierre just looked at the chasid, eyes wide in disbelief. "Return? Judaism?" He mumbled to himself. "I don't understand."

 

"The Baal Shem Tov told me to tell you that your real name is Pesach-Tzvi," continued Rabbi Nissan. "Both your parents were Jewish. Your mother wanted to give you a Jewish education but your father was opposed and prevailed. Eventually you lost your Jewish identity. But now it is time for you to return."

 

"I don't understand," said Pierre, trying to clear his throat, "Are you saying that I am a Jew? Me! A Jew? It's impossible! Absolutely impossible!"

 

Pierre Louis refused to discuss the subject further and abruptly ended the conversation. All he agreed only to give it further thought.

 

Almost a year later Rabbi Nissan heard a knock on his door. He opened it and was surprised to see a bearded Jew standing in front of him whom he didn't recognize. "Don't you recognize me?" the man queried.

 

Then Rabbi Nissan realized: It was Pierre Louis, now Pesach Tzvi, returning to the G-d of his fathers.

Rabbi Yisrael ben Eliezer [of blessed memory: 18 Elul 5458 - 6 Sivan 5520 (Aug. 1698 - May 1760 C.E.)], the Baal Shem Tov ["Master of the Good Name"-often referred to as "the Besht" for short], a unique and seminal figure in Jewish history, revealed his identity as an exceptionally holy person, on his 36th birthday, 18 Elul 5494 (1734 C.E.), and made the until-then underground Chasidic movement public. He wrote no books, although many works claim to contain his teachings. One available in English is the excellent annotated translation of Tzava'at Harivash, published by Kehos.
