Parshiyos Tzav, Shemini, Para, Laws of Pessach con't stories.

Parsha Tzav


In Vayikra, we were commanded to have sacrifices. The Cohanim and the Am learned the theory of the Korbanos. Now it was time to put them into action with the commissioning of the Mishkan in the wilderness.


6:1 And the LORD spoke unto Moses, saying: 2 Command Aaron and his sons, saying: This is the law of the burnt-offering: it is that which goes up on its firewood upon the altar all night unto the morning; and the fire of the altar shall be kept burning thereby.

Rabbi Dolinsky Shlita pointed out that the word Tzav or Command is for both speeding up the way the Cohanim sacrifice and the caution needed. It was not actually for Aaron and his sons as they were at the beginning of the Kahuna but for the future generations. In the times of the second Mikdash towards the end, authorities could be bribed to make people Cohain Gadol. One such a person married a rich widow. He used her money to bribe his way into being Cohain Gadol despite that the Torah permits a regular Cohain to marry a widow, a Cohain Gadol could only marry a virgin. As a result, ropes were tied to the Cohain Gadol when he went into the Kodesh Kadoshim on Yom HaKippurim as these ones would die. We read about Rabbi Channina the assistant or alternate Cohain Gadol as he used to take over. He had the merit and the ability to be particular in observance to be Cohain Gadol but not the money and protection with the authorities to be that way. 

3 And the priest shall put on his linen garment, and his linen breeches shall he put upon his flesh; and he shall take up the ashes whereto the fire hath consumed the burnt-offering on the altar, and he shall put them beside the altar. 4 And he shall put off his garments, and put on other garments, and carry forth the ashes without the camp unto a clean place. 5 And the fire upon the altar shall be kept burning thereby, it shall not go out; and the priest shall kindle wood on it every morning; and he shall lay the burnt-offering in order upon it, and shall make smoke thereon the fat of the peace-offerings. 6 Fire shall be kept burning upon the altar continually; it shall not go out.

Special garments are needed by the Cohanim and the fact that the fire on the Mizbayach shall be an eternal flame.

7 And this is the law of the meal-offering: the sons of Aaron shall offer it before the LORD, in front of the altar. 8 And he shall take up therefrom his handful, of the fine flour of the meal-offering, and of the oil thereof, and all the frankincense which is upon the meal-offering, and shall make the memorial-part thereof smoke upon the altar for a sweet savor unto the LORD. 9 And that which is left thereof shall Aaron and his sons eat; it shall be eaten without leaven in a holy place; in the court of the tent of meeting they shall eat it. 10 It shall not be baked with leaven. I have given it as their portion of My offerings made by fire; it is most holy, as the sin-offering, and as the guilt-offering. 11 Every male among the children of Aaron may eat of it, as a due for ever throughout your generations, from the offerings of the LORD made by fire; whatsoever toucheth them shall be holy.

We take a mundane thing like wheat guard it, winnow, sift, etc. and finally grind it into flour. This grain is turned into a sacrifice before G-D and baked in certain ways while other grains are turned into bread, cakes and Matzos. The mundane becomes holy. The wheat which we eat has the holiness of a pancake on Shevous, a Challa on Shabbos, a cake at the ceremony of Holy Matrimony, a loaf at a Bris, Lechem HaPanim (showbread) and Matzos for our Seder. It is no longer man living by bread alone.



12 And the LORD spoke unto Moses, saying: 13 This is the offering of Aaron and of his sons, which they shall offer unto the LORD in the day when he is anointed: the tenth part of an ephah of fine flour for a meal-offering perpetually, half of it in the morning, and half thereof in the evening.



This is one of the references to standardization and the Mitzvah of having proper weights and measures. The full commandment is writing later on in the Torah and each and every word of Torah is precious here.



14 On a griddle it shall be made with oil; when it is soaked, thou shalt bring it in; in broken pieces shalt thou offer the meal-offering for a sweet savor unto the LORD. 15 And the anointed priest that shall be in his stead from among his sons shall offer it, it is a due for ever; it shall be wholly made to smoke unto the LORD. 16 And every meal-offering of the priest shall be wholly made to smoke; it shall not be eaten.
How much does a sack of flour really cost? Add time and energy of the Cohanim and Mashgichim that guard the flour from Tuma from the cutting to the Mizbayach it becomes a lot more expensive and the same with the olive oil. Yet it is far from a Bull, Ram or Billy Goat and yet it is the meal-offering for a sweet savor unto the LORD. Just like the grilling of the most expensive prime steak.
17 And the LORD spoke unto Moses, saying: 18 Speak unto Aaron and to his sons, saying: This is the law of the sin-offering: in the place where the burnt-offering is killed shall the sin-offering be killed before the LORD; it is most holy.
The English translation uses killed therefore let us discard completely the non-Jewish translation which is the basis of the JPS and go for the Chabad translation: Speak to Aaron and to his sons, saying, This is the law of the sin offering: The sin offering shall be slaughtered before the Lord in the place where the burnt offering is slaughtered. It is a holy of holies.
Ritually slaughtering with the proper knife on the portion of the neck designated by the Oral Torah makes the difference between a Trafe chopping block or a slaughter where a blessing is made unto the L-RD G-D master of the Universe.
19 The priest that offers it for sin shall eat it; in a holy place shall it be eaten, in the court of the tent of meeting.
Not in a mundane area but in a special Holy area.
20 Whatsoever shall touch the flesh thereof shall be holy; and when there is sprinkled of the blood thereof upon any garment, thou shalt wash that whereon it was sprinkled in a holy place. 21 But the earthen vessel wherein it is sodden shall be broken; and if it be sodden in a brazen vessel, it shall be scoured, and rinsed in water. 22 Every male among the priests may eat thereof; it is most holy. 23 And no sin-offering, whereof any of the blood is brought into the tent of meeting to make atonement in the holy place, shall be eaten; it shall be burnt with fire.
Cleanliness and being Tahor allows for the work on the Mizbayach and the eating before G-D by the Priests in the state of holiness. Such a level we have not seen since the Romans destroyed our Temple. Even the Goyim should be ashamed of them for they burned down the ancient library in Alexandria Egypt. Now who were the real barbarians? We saw this as the Germans fled Paris and Hitler may his name be erased gave the command to leave Paris in ruins. The ancient Yerushalayim and Alexandria would have put Paris in their back pocket so we can only imagine how great these cities were and what social, cultural and worldly wisdom was lost by these barbarian soldiers.
7:1 And this is the law of the guilt-offering: it is most holy. 2 In the place where they kill the burnt-offering shall they kill the guilt-offering: and the blood thereof shall be dashed against the altar round about. 3 And he shall offer of it all the fat thereof: the fat tail, and the fat that covers the inwards, 4 and the two kidneys, and the fat that is on them, which is by the loins, and the lobe above the liver, which he shall take away by the kidneys. 5 And the priest shall make them smoke upon the altar for an offering made by fire unto the LORD; it is a guilt-offering. 6 Every male among the priests may eat thereof; it shall be eaten in a holy place; it is most holy. 7 As is the sin-offering, so is the guilt-offering; there is one law for them; the priest that makes atonement therewith, he shall have it … Too much Pessach cleaning, too much answering questions before Pessach and too close to sun down cuts short an exhausted Rabbi from writing at his best. May we soon merit these extra atonements for Am Yisrael very soon.

Parsha Shemini

9:1 And it came to pass on the eighth day, that Moses called Aaron and his sons, and the elders of Israel;
Rabbi Yitzchak opened up his Drasha on this Parsha as follows: Mishlei: 8:30 I was daily all delight, playing always before Him, and I don’t know why he did not use this Pasuk: 29 He appointed the foundations of the earth?
The Lubavitcher Rebbe in a Drasha regarding a Bris Milah talked about the nature of the Physical World 6 Days of Creation and 1 Day set aside called Shabbos Kodesh when the ABISHER rested from HIS creation. But the eight day is above and beyond the natural order of things in a World of Gashmiyous. Hence the Bris which is a spiritual or Ruchniyus Creation and I take the liberty of adding so the Mishkan too when it was dedicate on the 8th day the permanent Kehuna began to serve forever.
For when the Mishkan was dedicated the accuser came before G-D and said that mankind will provoke him. To which G-D replied that I am long - suffering with much Chessed. Rabbi Chiya commented in his Drasha that on the day the Mishkan was built, the Oral and Written Torah came together as is written: Bereshis 1:26 'Let us make man in our image, after our likeness; and let them have dominion over the fish of the sea, and over the fowl of the air, and over the cattle, and over all the earth, and over every creeping thing that creeps upon the earth.' This is the first time that I see the use of the Oral and Written Torah being consulted ‘us’, ’our image’ as the use of the plural in the creation. For it is Oral Tradition that G-D was consulting with the Angels during the creation of mankind along with his Midos and Attributes of Justice and Mercy and we see here also the two types of Torah.
2 and he said unto Aaron: 'Take thee a bull-calf for a sin-offering, and a ram for a burnt-offering, without blemish, and offer them before the LORD. 3 And unto the children of Israel thou shalt speak, saying: Take ye a he-goat for a sin-offering; and a calf and a lamb, both of the first year, without blemish, for a burnt-offering; 4 and an ox and a ram for peace-offerings, to sacrifice before the LORD; and a meal-offering mingled with oil; for to-day the LORD appears unto you.'

Be extra zealous and cautious for HASHEM is very close unto you.

…10:1 And Nadab and Abihu, the sons of Aaron, took each of them his censer, and put fire therein, and laid incense thereon, and offered strange fire before the LORD, which He had not commanded them.

They did what they were not asked to do and anybody who adds or subtracts from Torah deserves the Death Penalty and this is what happened with their addition.

2 And there came forth fire from before the LORD, and devoured them, and they died before the LORD.
Rabbi Pinchas Winston Shlita writes: The deaths Of Nadav and Avihu in this week’s parshah are always very troubling. No question that they made a BIG mistake in bringing their unauthorized fire before God, but still, on such an important occasion, kill them so dramatically? After all, it was their religious fervor that drove them, their intense desire to become even closer to God that inspired them, so why punish them so severely?

One thing is for certain: God did not overdo it. Unlike a parent, who can overreact to a child's transgression and make the punishment a little more than called for, God punishes only measure-for-measure. Humans can make the mistake of overkill, but God's responses are right on the mark, and if they do not appear that way to us, it is because we don't understand the severity of what went wrong.

I want you to understand that we have an Oral tradition that:
(1) Nadav and Avihu were not married. The Torah in Acharei Mos (after their deaths) mentions that on Yom Kippur that the Cohain Gadol has to make atonement for himself and his house – Chachamim (Sages) tell us that his house indicates his wife. Not getting married for a Cohain is not holiness that he is with G-D all the time but that by not performing the Mitzvah of procreation, he is in fact sinning.
(2) The two sons of Aaron were inebriated with too much wine. In the Midrash we are told that wine leads to levity and this in combination with circumstances can lead to lewdness. For example: a wife might say to her husband in the middle of an act that a red flower has broken out and he must let the player of the act die. However, in an inebriated condition he continues with a Niddah. This goes for other things. It once happened on Purim that one Chassid of the Lubavitcher had too much Vodka and he staggered home and beat his wife to a pulp. The Rebbe then made a Gezaira that one cannot drink more than three shots of Vodka at a Verbrenung.
A Rabbi can say things that embarrass his office. Once I heard a first born son tell me in private as I chatted with the current Pittsburgher Rebbe Shlita in his father’s Sukkah, “Go home your wife is waiting for you.” All I can tell you is that a Heilige Rebbe does not talk so lewdly. Wine can also bring out secrets about people. There was once a Kabbalist who died of siroccos of the liver because he used wine while studying Kabbala. Perhaps he too brought strange fire before the L-RD like the sons of Aaron who were very holy in all aspects.
3 Then Moses said unto Aaron: 'This is it that the LORD spoke, saying: Through them that are nigh unto Me I will be sanctified, and before all the people I will be glorified.' And Aaron held his peace. 4 And Moses called Mishael and Elzaphan, the sons of Uzziel the uncle of Aaron, and said unto them: 'Draw near, carry your brethren from before the sanctuary out of the camp.' 5 So they drew near, and carried them in their tunics out of the camp, as Moses had said. 6 And Moses said unto Aaron, and unto Eleazar and unto Ithamar, his sons: 'Let not the hair of your heads go loose, neither rend your clothes, that ye die not, and that He be not wroth with all the congregation; but let your brethren, the whole house of Israel, bewail the burning which the LORD hath kindled. 7 And ye shall not go out from the door of the tent of meeting, lest ye die; for the anointing oil of the LORD is upon you.' And they did according to the word of Moses.
Cohanim have different mourning than the rest of the Nation. When my son-in-law’s grandfather, the Cohain, passed away my Mechutan (daughter’s father-in-law) went to identify the body just before burial.
8 And the LORD spoke unto Aaron, saying: 9 'Drink no wine nor strong drink, thou, nor thy sons with thee, when ye go into the tent of meeting, that ye die not; it shall be a statute forever throughout your generations. 10 And that ye may put difference between the holy and the common, and between the unclean and the clean; 11 and that ye may teach the children of Israel all the statutes which the LORD hath spoken unto them by the hand of Moses.'
11:1 And the LORD spoke unto Moses and to Aaron, saying unto them: 2 Speak unto the children of Israel, saying: These are the living things which ye may eat among all the beasts that are on the earth. 3 Whatsoever parts the hoof, and is wholly cloven-footed, and chews the cud, among the beasts, that may ye eat. 4 Nevertheless these shall ye not eat of them that only chew the cud, or of them that only part the hoof: the camel, because he chews the cud but parts not the hoof, he is unclean unto you. 5 And the rock-badger, because he chews the cud but parts not the hoof, he is unclean unto you. 6 And the hare, because she chews the cud but parts not the hoof, she is unclean unto you. 7 And the swine, because he parts the hoof, and is cloven-footed, but chews not the cud, he is unclean unto you. 8 Of their flesh ye shall not eat, and their carcasses ye shall not touch; they are unclean unto you.
Recently countries befriending the Arab Nations have begun using camel’s milk in chocolates and selling camel’s milk for its “benefits”. It is forbidden to eat/drink these products. Pork is a staple in many countries and bacon is most tasty – fortunately we have soy substitutes which taste almost the same and have no harmful fat. We don’t eat these animals or products not because of health reasons, not because of bad taste, not because of lack of protein or nutritional value but because G-D forbade them unto us. He just us from all the peoples of the earth and we are HIS “Nation of priests”, “A light among the Goyim” and a “Holy People”.
9 These may ye eat of all that are in the waters: whatsoever hath fins and scales in the waters, in the seas, and in the rivers, them may ye eat. … 13 And these ye shall have in detestation among the fowls; they shall not be eaten, they are a detestable thing: the great vulture, and the bearded vulture, and the osprey; 14 and the kite, and the falcon after its kinds; 15 every raven after its kinds; 16 and the ostrich, and the night-hawk, and the sea-mew, and the hawk after its kinds; 17 and the little owl, and the cormorant, and the great owl; 18 and the horned owl, and the pelican, and the carrion-vulture; 19 and the stork, and the heron after its kinds, and the hoopoe, and the bat. 20 All winged swarming things that go upon all fours are a detestable thing unto you.
On the Wings of Eagles – or perhaps I have the wrong bird By Rabbi Yirmiyohu Kaganoff
Question #1: My Chavrusa and I are studying Chullin, and we recently discovered a Tosafos who states that a nesher is not an eagle; yet every Chumash I have seen translates kanfei nesharim as the “wings of eagles.” Are all these translators ignorant of this Tosafos? In Modern Hebrew a Nesher is a Vulture!
Question #2: While camping in Western Canada, we saw thousands of wild, roaming, land birds called “prairie chicken,” that are clearly different from the common, familiar chicken, but appear similar enough that I was tempted to bring one to a Shochet to prepare for us. Halachically, could I have done this?
(A third question was written and the answer will come next week so I have removed the question for now.)
To answer these questions accurately and thoroughly, we need to explain the background how one identifies kosher and non-kosher species, and the differences in Halachic practice that have developed.
The Torah describes the exact indicators that render fish and animals kosher, providing us with relatively clear simanim, indicating signs, to determine whether a species is kosher or not. However, regarding birds the Torah simply inventories a list of non-kosher varieties, implying that all other birds are acceptable for the Jewish palate (Vayikra 11:13- 19; Devarim 14:11- 19). Indeed, the Gemara notes that there are countless kosher bird species (Chullin 63b). After analyzing the Torah’s list, the Gemara concludes that 24 varieties (or possibly, categories) of bird are non-kosher, the remaining species all being kosher (Chullin 61b). Thus, someone who can identify all 24 species of non-kosher fowl could indeed shecht and eat any other species of bird he discovers. Furthermore, the Gemara rules that a hunter who recognizes all 24 non-kosher species may teach other people which species are kosher (Chullin 63b).
On this basis, why do we restrict ourselves to eating only familiar species? Also, is there any way that a non-hunter can identify whether a bird is kosher?
KOSHER BIRD SIMANIM
Are there any signs that indicate whether a variety of bird is kosher?
The answer is yes and no.
The Mishnah, indeed, lists four simanim that identify a bird as kosher. However, before introducing and explaining the four simanim, I need to clarify a major difference between the function of simanim in identifying kosher birds as opposed to those of fish and land animals. Any animal that possesses both simanim, that is, it has both fully split hooves and chews its cud, is kosher; any animal possessing one siman but not the other is definitely non-kosher. In the case of fish, the Torah rules that any species that possesses both fins and scales is kosher; and the Mishnah teaches that there are no species possessing scales that do not possess fins. Thus, any species of fish possessing scales is kosher, and any without scales is not.
In the case of birds, however, a bird containing all four kosher simanim is definitely kosher, and a bird that possesses none of the four simanim is not kosher. Concerning birds that possess some of the four signs but not all, some are kosher and some are not. The Gemara teaches that of the 24 species mentioned by the Torah, only the nesher lacks all four simanim. (Rashi explains that any bird variety lacking all four kosher simanim is considered a sub-category of nesher. We will see shortly why I have not translated the word nesher.) The peres and the azniah, two of the 24 non-kosher varieties, each possesses only one of the kosher simanim and lacks the other three. The oreiv usually identified as the raven (see Tosafos, Chullin 62a s.v. mipnei who discusses whether this identification is accurate) and the zarzur each has two kosher simanim and lack the remaining two, and the remaining 19 types of non-kosher bird each has three of the simanim and lacks only one. (This follows the approach of most interpretations of this passage of Gemara.)
However, there are many varieties of kosher bird that only possess some kosher signs and lack others. For example, geese contain only three of the four kosher simanim, and yet are 100% kosher!
Any bird possessing some, but not all, of the simanim is still kosher if it is not one of the 24 species listed by the Torah. Since this is true, how can one tell whether a bird containing some kosher signs is indeed kosher? Only if one knows all 24 types of non-kosher birds mentioned in the Torah, could one thereby identify the remaining kosher varieties. This is exactly what the expert hunter of the Gemara does. Furthermore, he may educate others that a specific species is kosher. However, those of us without access to his expertise would not be able to consume birds unless we had a Mesorah, an oral tradition, that this is a kosher bird, in which case one could eat it even if it does not have all four kosher simanim (Chullin 63b).
IDENTIFYING KOSHER WITHOUT A MESORAH
According to the Mishnah, someone who finds a variety of bird for which he has no Mesorah may still eat it based on the following rules:
“Any bird that is doreis (defined below) is not kosher. Any that possesses an “extra claw,” and has a crop, and whose gizzard can be peeled is kosher (Chullin 59a).” I will shortly explain what these simanim are.
According to Rashi, the Mishnah is teaching that if we can identify a bird that has all four of the simanim, that is, it is not doreis, it possesses an “extra claw,” has a crop, and has a gizzard that can be peeled, the bird is definitely kosher. The Gemara records that all the varieties of dove mentioned by the Torah as Korbanos have these four indicating simanim. Thus, according to Rashi’s understanding of the Mishnah, one may only eat a variety of bird that has no Mesorah if it possesses all four simanim. (It should be noted that most other Rishonim interpret the Mishnah differently, and indeed rule that, under certain very specific circumstances, one may eat certain birds based on some, but not all, of the simanim.)
Although a bird may have only some of the four simanim and still be kosher, any bird with all four simanim is unquestionably kosher according to the Mishnah.
What are the four simanim?
DOREIS
I. Any bird that is doreis is not kosher. Thus, the kosher siman is that a bird is not doreis.
People often mistranslate the word doreis as predator. However, this is inaccurate, since chickens, which the Mishnah teaches are kosher, are technically predators since they feast on worms and insects.
The Rishonim debate what the word doreis means; here are five different interpretations:
A. The bird lifts its prey from the ground with its claws when feeding (Rashi, Chullin 59a s.v. hadoreis).
B. It grips and restrains its food while eating (Rashi, Chullin 62a s.v. vehani milei).
C. It preys on smaller birds or rodents, which it devours while they are alive (Rabbeinu Tam, cited in Tosafos Chullin 61a s.v. hadoreis).
D. It poisons with its talons (Ran, Chullin, page 20b in Rif, as explained by the Aruch HaShulchan 82:5) (A talon is a claw, but the word "talon" is typically used only for predators.)
E. It pounces on its prey with its talons (the above-quoted Ran, as explained by the Shach, Yoreh Deah 82:3).
Thus, by observing a bird’s feeding and clawing behavior one may be able to determine that it is non-kosher.
It must be emphasized, that although all birds that are doreis are non-kosher, the inverse is not true. There are varieties of fowl that are not doreis, yet nevertheless are not kosher.
The Gemara does not state that a bird must be doreis frequently to qualify as such. Rather, it implies that a bird is non-kosher if it is ever doreis (Chullin 62b). Thus, it may be difficult to easily identify a bird as a non-doreis, a fact with major ramifications.
INDICATIONS OF DOREIS
The Mishnah records an alternative method of verifying whether a bird is doreis: Rabbi Eleazar ben Rabbi Tzadok rules that any bird that splits its talons, two before and two behind, when it grips a rope, is doreis and therefore not kosher (Chullin 59a, as explained there by the Gemara 65a). (Note that the Halachic authorities all quote this opinion as definitive [Tosafos Yom Tov ad loc.].)
It is noteworthy that an early Halachic authority cites a different Mesorah for identifying a bird that is not doreis. Any bird with a wide beak and webbed feet is not doreis (Baal HaMaor). The Rishonim quote this approach and it is recorded in Shulchan Aruch (Yoreh Deah 82:3).
Tosafos raises a question: How did Chazal research that not one kosher species anywhere in the world is doreis? How can the Gemara confidently say that none of hundreds of kosher bird species is doreis? Tosafos rules out the explanation that this was an oral tradition communicated to Moshe Rabbeinu at Har Sinai (Halacha LeMoshe MiSinai) because if that were true, the Torah need not have mentioned all 24 varieties of non-kosher bird in order to identify all non-kosher varieties. Instead, it could have succinctly taught that all birds that are doreis are non-kosher, and in addition, listed the remaining small list of non-kosher birds that are not doreis.
Tosafos concludes that Noah, who knew which birds are kosher and which are not, observed that none of the kosher varieties were doreis (Chullin 61a s.v. kol of). Thus, the siman that a doreis is not kosher is an oral tradition dating back to Noah.
BODY SIMANIM
So far, we have identified one siman that identifies some non-kosher birds, which is based on avian feeding behavior. The other simanim are all anatomical features, two internal and one external. One of these simanim is the crop such as is found in doves, chickens, and most, but not all, varieties of bird that we are accustomed to consider kosher.
What is a crop?
The crop is a very interesting part of a bird’s digestive system. It is essentially a storage bag for undigested food that Hashem provided for smaller birds to enable them to survive in the wild. A brief description of the life of a small bird will help us understand the Chessed Hashem performed for these birds.
Smaller birds always need to worry that they are potential lunch for larger ones. As such, they must be careful to expose themselves to harm very briefly before returning to their safe hideouts. What happens if a small bird finds a plentiful supply of seeds that would keep it satisfied for a while, but the seeds are located in a place where a leisurely feast could easily render the bird into an available dinner for a predator?
Hashem came to the rescue of the smaller bird and provided it with a crop! The crop does not digest the food, but functions as an expandable storage pouch allowing the small bird to gobble its food quickly. Once the gizzard and crop hold as much as they possibly can, the bird escapes to its safe cover, secure from predators. At this point, the gizzard grinds the seeds inside it, and when empty receives more from the crop. This way the bird gradually turns into nutrition what it quickly gobbled without having to reach for a bottle of Tums to recover from the huge indigestion that afflicts humans when they eat too much at one time.
REASONS FOR A CROP
Although we cannot be certain of the reasons for the Torah’s mitzvos, the commentators conclude that we should attempt to understand why the Torah commanded us concerning the mitzvos. Perhaps the crop is a siman of kosher birds since smaller birds that eat seeds usually possess this organ in order to protect themselves from predators. Thus, although man usually lauds the large, impressive birds such as the eagle, falcon, and condor, the Torah is teaching that its message is better conveyed through the smaller birds that protect themselves by fleeing. We find this idea in a Midrash, which points out that the only bird kosher for the Mizbayach are doves, which are hunted by larger birds of prey.
ONE CAN PEEL ITS GIZZARD
One of the four simanim of a kosher bird is that one can peel off the inside of its gizzard. We are all familiar with a chicken’s gizzard, although many of us know it by its Yiddish name, the pupek. The hard muscle of the pupek grinds the food, which begins its digestive process. A bird swallows its food whole, which means that its gizzard must accomplish what humans achieve with their teeth and saliva.
How does the toothless bird “chew” the seeds it eats? Hashem, who provides food even for the young raven (Tehillim 147:9), provided all birds with the ability to digest their food in incredible ways. The bird swallows pebbles which are held in the gizzard. The powerful gizzard muscles grind the food with these pebbles.
The special lining of the gizzard protects the gizzard itself from becoming damaged by these stones. In birds containing all four kosher simanim, this lining of the gizzard can be peeled off the gizzard (obviously, only post-mortem).
BY HAND OR BY BLADE?
The Gemara discusses eight varieties of bird that have uncertain kashrus status. In all eight cases, the birds were not doreis and may have been kosher. However, these birds’ gizzards can be peeled only by a knife, and not with one's fingernails. The Gemara was uncertain whether this qualifies as a kosher siman. Since we cannot positively identify these eight varieties of bird as kosher, and we have no Mesorah identifying them as such, we must treat them as non-kosher (Chullin 62b).
AN EXTRA CLAW
One of the four simanim that can identify a bird as definitely kosher is the possession of an “extra claw.” Where is this extra claw located?
The Rishonim disagree, some understanding that this claw points in the opposite direction from the other claws of the birds; whereas others explain that in addition this claw must protrude at a higher point on the leg than the other claws. A third approach understands that the claw is on the same side of the bird’s leg as the other claws but protrudes outward farther than the others.
Although these differences seem rather technical for those of us who are not habitual bird watchers, there is a significant nomenclature concern that results from this discussion. Is a nesher indeed an eagle?
Chazal tell us that of the 24 non-kosher birds identified by the Torah, only a nesher lacks all four kosher signs. This means that only a nesher is doreis, does not possess an “extra claw,” is crop-less, and has a gizzard that cannot be peeled. Any bird that has some of these simanim, but not all, may indeed not be kosher, but it is not a nesher.
IS THE NESHER AN EAGLE?
“Everyone” knows that a nesher is an eagle. However, Tosafos notes that an eagle possesses a talon that is opposite the other claws on its leg, and on this basis he concludes that a nesher cannot possible be an eagle since a nesher should not have this sign (Chullin 63a s.v. neitz). Those of us distressed to discover that the United States national bird is not a nesher will find solace in the explanation offered by the Aruch HaShulchan – that the kosher siman is that the opposing claw must also be raised higher than the other claws -- whereas an eagle’s opposing claw is directly opposite the other claws (Yoreh Deah 82:3). Thus, our national pride indeed possesses no signs of kashrus!
21 Yet these may ye eat of all winged swarming things that go upon all fours, which have jointed legs above their feet, wherewith to leap upon the earth; 22 even these of them ye may eat: the locust after its kinds, and the bald locust after its kinds, and the cricket after its kinds, and the grasshopper after its kinds. 23 But all winged swarming things, which have four feet, are a detestable thing unto you. 24 And by these ye shall become unclean; whosoever touches the carcass of them shall be unclean until even. 25 And whosoever bears aught of the carcass of them shall wash his clothes, and be unclean until the evening. … 43 Ye shall not make yourselves detestable with any swarming thing that swarms, neither shall ye make yourselves unclean with them, that ye should be defiled thereby. 44 For I am the LORD your God; sanctify yourselves therefore, and be ye holy; for I am holy; neither shall ye defile yourselves with any manner of swarming thing that moves upon the earth. 45 For I am the LORD that brought you up out of the land of Egypt, to be your God; ye shall therefore be holy, for I am holy. 46 This is the law of the beast, and of the fowl, and of every living creature that moves in the waters, and of every creature that swarms upon the earth; 47 to make a difference between the unclean and the clean, and between the living thing that may be eaten and the living thing that may not be eaten.


Parsha Para


19:1 And the LORD spoke unto Moses and unto Aaron, saying: 2 This is the statute of the law which the LORD hath commanded, saying: Speak unto the children of Israel, that they bring thee a red heifer, faultless, wherein is no blemish, and upon which never came yoke.
With the possible exception of the story of the golden calf, the Sages could find no logic behind this law and it was the one Halacha that Melech Shlomo could not figure out. It is a Chok which is a Halachic equivalent to a constitutional law.
3 And ye shall give her unto Eleazar the priest, and she shall be brought forth without the camp, and she shall be slain before his face. 4 And Eleazar the priest shall take of her blood with his finger, and sprinkle of her blood toward the front of the tent of meeting seven times. 5 And the heifer shall be burnt in his sight; her skin, and her flesh, and her blood, with her dung, shall be burnt.
With the exception of the sprinkled blood everything else is burned. This is the only Korban where the blood itself is burned!
6 And the priest shall take cedar-wood, and hyssop, and scarlet, and cast it into the midst of the burning of the heifer. 7 Then the priest shall wash his clothes, and he shall bathe his flesh in water, and afterward he may come into the camp, and the priest shall be unclean until the even. 8 And he that burns her shall wash his clothes in water, and bathe his flesh in water, and shall be unclean until the even.
Pasukim 7 and 8 appear to be a repeat but it appears to me that the first Pasuk is dealing with the Cohain who slaughters the Parah and the second
 9 And a man that is clean shall gather up the ashes of the heifer, and lay them up without the camp in a clean place, and it shall be kept for the congregation of the children of Israel for a water of sprinkling; it is a purification from sin. 10 And he that gathers the ashes of the heifer shall wash his clothes, and be unclean until the even; and it shall be unto the children of Israel, and unto the stranger that sojourns among them, for a statute forever.
This deals with the Cohain that gathers the Ashes for purification. We then go to the rules regarding a Yisrael or Levi who touched the corpse or was under a tree, building or tent when the corpse was under it.
11 He that touches the dead, even any man's dead body, shall be unclean seven days; 12 the same shall purify himself therewith on the third day and on the seventh day, and he shall be clean; but if he purify not himself the third day and the seventh day, he shall not be clean. 13 Whosoever touches the dead, even the body of any man that is dead, and purifies not himself--he has defiled the tabernacle of the LORD--that soul shall be cut off from Israel; because the water of sprinkling was not dashed against him, he shall be unclean; his uncleanness is yet upon him. 14 This is the law: when a man dies in a tent, every one that cometh into the tent, and every thing that is in the tent, shall be unclean seven days. 15 And every open vessel, which hath no covering close-bound upon it, is unclean. 16 And whosoever in the open field touches one that is slain with a sword, or one that dies of himself, or a bone of a man, or a grave, shall be unclean seven days.
We now include one who has even contacted a small human bone or an olive bulk of flesh.
17 And for the unclean they shall take of the ashes of the burning of the purification from sin, and running water shall be put thereto in a vessel. 18 And a clean person shall take hyssop, and dip it in the water, and sprinkle it upon the tent, and upon all the vessels, and upon the persons that were there, and upon him that touched the bone, or the slain, or the dead, or the grave. 19 And the clean person shall sprinkle upon the unclean on the third day, and on the seventh day; and on the seventh day he shall purify him; and he shall wash his clothes, and bathe himself in water, and shall be clean at even. 20 But the man that shall be unclean, and shall not purify himself, that soul shall be cut off from the midst of the assembly, because he hath defiled the sanctuary of the LORD; the water of sprinkling hath not been dashed against him: he is unclean.
There is a qualification that is one must be in Eretz Yisrael and have the accessibility to the ashes. Nowadays, we have access to Yisrael but not to Kares does not apply since the majority of the Bnei Yisrael are Tumay we are allowed now to sacrifice a Korban Pessach from Tuma. The other Korbanos could not be released for working on/with for they would require a higher level of purity.

 Laws of Pessach Continued Shmura Matzos

The need for matzah Shmura comes from the Toraitic statement “U’shmartem Es HaMatzos” (“And you shall guard the Matzos”). There are three types of Shmura, which literally means “watched.”
As previously mentioned, if water comes into contact with one o the five species of grain and is allowed to stand for 18 minutes, it becomes Chometz. If dough is constantly kneaded, it will not ferment. Matzah must be made with these five species of grain and also must be made with water. What is required is guarding that the dough or the grains not be allowed to stand 18 minutes once they have come in contact with water. They must be baked within that time.
The three types of Shmura matzah are:
  1. Mishaas K’tzirah - watched from the time of reaping (harvesting)
  2. Mishaas Techina - from the time of grinding (milling)
  3. Mishaas Lisha - from the time of kneading
A grain may become Chometz any time after reaping (after it is removed from its organic source of growth) if it has come into contact with water. Therefore it must be carefully guarded.
Although we eat matzah all Pesach, one is only legally obligated to eat matzah on the first night of Pesach (in Eretz Yisroel) and the first two nights in the diaspora. This of course does not mean that Chometz may be eaten; IT MAY NOT. Therefore we are especially careful with the matzos that we eat that night (or those nights).Matzos commonly bought in supermarkets or grocery stores that are “Passover Matzos” are also shmurah matzos. However they are NOT sufficient to fulfill one’s obligation. First, they are only watched from the time of kneading, which is in itself not desirable, but more importantly, they lack another essential condition, that of being baked “L’Shame Matzas Mitzvah” (“for the sake of the commandment”).Therefore while they may be permitted the rest of Pesach they may not be used to fulfill one’s obligation to eat matzah on the first night of Pesach (first two in diaspora).Most G-d fearing people eat only matzah shmurah mishaas k’tzirah the entire Pesach. However, those who do not do so have authorities upon whom to rely.
The matzah used to fulfill to Toraitic precept of eating matzah must be made “L’shma,” for the sake of the mitzvah. Therefore, all the steps of the production must be made with the intention of L’shame Matzos Mitzvah. Many authorities question the permissibility of using machine matzos even if the one who pushed the button on the kneading blenders has the proper intention. Therefore, hand matzos, in which the kneading and the putting in the oven are done by hand, are preferred. There are, in addition, mills that grind the flour for matzos, which are “Rachayim shel yad” hand mills, and “Rachayim shel mechona” machine mills. On the other hand, there are those who say that the machine-kneaded dough is more homogeneously worked and there is less chance of fermentation, concluding that it is preferable to use machine matzos. There are authorities that hold that if the one who pressed the button had the proper intention it has been made “L’shame Matzos Mitzvah.”
It is accepted today that hand matzos are most preferred. (The author, having observed and supervised both processes, has no question that the well-supervised hand matzah baking is superior in both aspects, L’Shame Matzos Mitzvah, and Chometz free.)
Matzos must be baked with water that has been placed in a cool place over night and must stay at least 12 hours. It is preferable to draw the water just before sunset. If, however it was done earlier, or later, it is acceptable if it stayed 12 hours. This is called Mayim SheLanu. If Mayim shelanu was intentionally not used, the matzos are forbidden. However, if no other matzos are available for matzah the first night, it may be used. If unintentionally not used, then they are permitted. Egg matzah is totally unacceptable to fulfill the obligation of eating matzah. In fact, egg matzah should not be bought at all unless health reasons require it. If for health reasons one cannot eat matzah, he should consult a competent orthodox rabbinic authority.
At the Seder, matzah should be eaten while leaning on one’s left side.

4 cups Arbah Kosos

On the first night of Pesach (first two in the diaspora) it is incumbent upon every Jewish man, woman, and educable child to drink four cups of wine in recognition of the four expressions of freedom mentioned in the Torah in connection with Yitzias Mitzrayim (the going out of Egypt). The four expressions can be found in Exodus 6:6-7. They are: V’Hotzaisi, V’Hitzalti, V’Ga’alti, and V’lakachti. (The Gra holds that V’lakachti is a “taoos sofer” in the Yerushalmi and the fourth expression is a repetition of V’Ga’alti.) There is actually a fifth expression, which a minority opinion holds requires a fifth cup. We DO NOT hold in accordance with this opinion and a fifth cup MAY NOT be drunk.
As during the entire year one should be extremely careful to purchase and drink only kosher wine. It is most preferred to use red wine on Pesach for the Seder.
The keynote of Pesach is freedom. Consequently, as an expression of freedom, rabbinic enactment mandates leaning to one’s left side while drinking the cups of wine. The reason we lean (called “hasayba”) is that wealthy people used to recline on a couch while eating, and, for health reasons, (Shema Yakdim Kana L’Veshet) leaned on the left. Even left-handed people must lean to the left. Leaning to the right is not considered leaning. So important is this expression of freedom, that according to the Rama, if one does not drink the first two cups while leaning, he must revert and drink an additional cup for every cup drunk while not leaning. Since there are authorities who hold that, nowadays, we do not require leaning, since it is no longer the mode of freedom, and an additional opinion who holds that between the first and second cup no wine may be drunk lest it be construed as adding to the Mitzvos, one MUST ONLY return for the second cup if he did not lean on his left side.
It is customary to have someone else pour cups for the one who leads the Seder as an expression of freedom.
If one has difficulty drinking four cups of wine during the Seder in their proper place, he may use grape juice (only kosher grape juice with rabbinic supervision). One may not drink all four cups consecutively, one after another. Women are obligated to eat matzah and drink four cups.
As with the eating of the matzah, there is a minimum requirement that must be consumed. One should have a cup of at least 4.42 fl. oz. for Kiddush if Pesach falls on Shabbos, and of at least 3.3 fl. oz. if not. All other cups require only 3.3 fl. oz., according to Rabbi Moshe Feinstein. The Chazon Ish requires 150 cc or 5.072 fl. oz. The leader of the Seder should remind everyone to lean while eating the matzah and drinking the wine.

Maror

The reason we eat Morror, or bitter herbs, is to remind us that there was great bitterness in Egypt. It is an unusual person who can make himself feel this bitterness and appreciate the great kindness of G-d for taking us out of Mitzrayim. Our Sages, keenly aware of this, required us to continue the Toraitic precept of “Al Matzos U’M’ror’rim Yochluhu,” (to eat the Paschal sacrifice with the matzah and Morror) even though the sacrifice is no longer offered. The bitterness of the herbs may help us appreciate, perhaps a little, the magnitude of this great suffering. One should not fool himself into thinking that he can begin to feel this unless he is quite knowledgeable of the events that took place.
The measurement for Morror is 8 in. x 10 in., if Romaine lettuce is used, or an amount equivalent to ½ of an egg (at least 1/3), if pure horseradish is used. Extreme care should be taken by one using romaine lettuce, since there are often little worms and bugs in the leaves. Horseradish normally bought in stores is insufficient since sweeteners are added to make them less bitter. Morror which has been cooked or boiled is unfit to fulfill one’s obligation. Morror soaked over 24 hours in water is also not acceptable.
For Koraich, a smaller measurement is used. The measurement for Morror in fl. oz. is 1.1, and for Koraich, .7 fl. oz. If romaine lettuce is used for Koraich, the measurement of 3.6 in. x 7.2 in. is used. Rav Elyashiv Shlita holds that 15 grams of Morror is sufficient (0.529 oz.).

Magid (the telling of the Sippur of Yitzias Mitzrayim)

The telling of the going out of Egypt is what the Seder is really concerned with. Although the other laws are extremely important, the story of Yitzias Mitzrayim should be told in great detail.
One should make every effort to learn about Yitzias Mitzrayim in order to tell their children, which is the fulfillment of the mitzvah “V’higadta L’vincha . . .” (“and you shall tell your children . . .”) which is a Toraitic commandment.

Kadaish (sanctifying)

It is customary that someone else pours the wine, not the one who conducts the Seder.
The one who says Kiddush should have in mind (and should announce before he begins) that he will me “motzei” all those who listen to every word and concentrate on fulfilling their obligation to hear Kiddush. If the first night is Shabbos, then all necessary insertions pertaining to Shabbos must be made. If the first or second night is Motzei Shabbos, the Havdalah is said immediately after Kiddush, its order of blessing being: wine, Kiddush, Borei M’Orei HaAish, HaMavdil Bain Kodesh L’Kodesh, and also have in mind the mitzvos of the night i.e. Haggadah, Matzah etc. Then, one should Lechatchila (from the start) drink the entire cup or if difficult, at least drink more than half a cup containing a R’veeis of wine must be drunk in one sip by each participant while leaning to the left side. The second cup should be poured immediately after the drinking of the first to stimulate questioning by small children.

Urchatz (the washing of the hands)

After the Kiddush, we wash our hands without a brocho. We do this for two reasons.
  1. Any detached food dipped in one of the seven fluids (water, wine, blood, dew, milk, olive oil and bee honey) makes food susceptible to spiritual uncleanliness and requires washing of hands.
  2. Since we are not accustomed to dipping, we do it to provoke questions from the children who observe us doing something unusual.
The opinion of the Vilna Gaon is to make a brocho for this washing. It is customary, that the one who heads the Seder does not leave the room to wash his hands, but has the water brought to him.

Karpas (celery or parsley - some use radishes or potatoes)

We take a piece of vegetable, preferably green, less than a k’zayis (size of an olive) and dip it into salt water or vinegar and say the brocho “Borei Pri (fruit) HaAdama (ground),” having in mind the Morror which we will eat later. Since the Morror to come is eaten because of the mitzvah, and not as part of the meal, the blessing of “HaMotzei” will not cover it. Normally, if one eats more than a k’zayis, he requires a brocho achrona (an after blessing). Therefore, one should be careful not to eat more than a k’zayis and not necessitate a brocho. If one inadvertently ate more than a k’zayis, b’dieved (ex post facto or happened in the past), he need not make a brocho achrona.

The Prince, the Queen and the Rabbi by Rabbi Yerachmiel Tilles


One time, Rabbi Marvin Hier was invited to a very special dinner in Victoria Canada with Queen Elizabeth II of England [and other Commonwealth nations such as Canada] and her husband, Prince Phillip. He informed the organizers that although he was quite touched and flattered by the invitation, he would be unable to attend because of his special dietary needs.
But the Canadian government held Rabbi Hier [who led the Shaarei Tzedek Congregation in Vancouver, B.C., Canada, from 1964-1977,] in great esteem. They were willing to accommodate his every wish. And so, they assured him that he would have his own set of dishes and cutlery and of course, special kosher food.
Greeted by Queen Elizabeth herself, Rabbi Hier and his wife were quite honored to attend a dinner of such dignitaries. But, to their chagrin, after the first course, in an effort to allow all the guests to acquaint themselves with one another, all the guests were asked to move to another seat.
A nice idea, but not for the Rabbi and his wife. For them it created quite a problem. What would he now do about his kosher food and utensils? Although it would look strange, he and his wife decided that they were going to have to bring along their dishes and cutlery to whichever seat they moved to. Indeed, there were those who stared and thought it to be quite strange and even rude. In fact, one unaffiliated Jew was quite disturbed by the "Hillul Hashem" (disgracing of G-d's name). How could it be that the Rabbi would act in such a difficult manner when the royal family had gone to such great lengths to accommodate him, he challenged.
Regardless of what it looked like, the Rabbi was not about to compromise on his standards. And so, he brought his plate with him wherever he went. The Queen and her husband walked about the room greeting the various dignitaries. And when Prince Phillip noticed the Rabbi standing with his plate in his hands, he asked about the peculiar behavior.
Rabbi Hier explained why he had to carry around his dishes and utensils, and his explanation impressed the prince. Expressing curiosity as to the details of this religious practice, the prince engaged the rabbi in a relatively lengthy discussion about the laws of keeping kosher. Eager to share this new revelation, Prince Phillip even included Queen Elizabeth in the conversation.
Shortly thereafter, seeing how well received the Rabbi was, this irreligious fellow decided that he, too, would capitalize on his Jewishness. He approached Prince Phillip and introduced himself as another Jew. But the prince looked at him disapprovingly and asked him one piercing question: "If you are a Jew, then where are your dishes?"
Needless to say, the embarrassed fellow sheepishly walked away.

Demonstration Alert - U. S. Embassy Jerusalem (March 28, 2019)

Location:  Announced gathering points include, but are not limited to, Gaza and city centers in the West Bank.  Locations throughout Israel and the West Bank could also be settings for demonstrations, protests, and police, military, and/or civilian response.  Security incidents, including rocket fire, can occur well beyond Gaza and its periphery and at any time, as demonstrated by the March 14 and March 25 rocket attacks in Central Israel. 

Event:  Demonstrations are expected to take place March 29-30 on the anniversaries of the March of Return and Land Day.  Previous demonstrations have sometimes encountered a strong security force presence and response. 

In the event of mortar and/or rocket fire, a Red Alert siren may be activated.  Treat all such alerts as real; follow the instructions from local authorities and seek shelter immediately.  For additional information on appropriate action to take upon hearing a siren or explosion, see the Israel Defense Forces Home Front Command website.  Know the location of your closest shelter or protected space.
