Last
week, we had the revolutionary concept of land and inheritance ownership by
women. This week strangely we see that a husband or father can nullify a vow by
a spouse or daughter. The first reason is maturity the second is parental wisdom.
30:2 And Moses spoke unto the heads of the tribes of the
children of Israel, saying: This is the thing which the LORD hath commanded. 3 When a man vows a vow unto the LORD,
or swears an oath to bind his soul with a bond, he shall not break his word; he
shall do according to all that proceeds out of his mouth.
No wonder in Perkei Avos that a fence around
being wise is keeping ones mouth shut.
4 Also when a woman vows a vow unto the LORD, and binds
herself by a bond, being in her father's house, in her youth, 5 and her father hears her vow, or her
bond wherewith she hath bound her soul, and her father holds his peace at her,
then all her vows shall stand, and every bond wherewith she hath bound her soul
shall stand.
The key here is “in her father’s house” meaning
that she is under the age of ‘maturity’ of Torah times which was 12 for a girl
or 13 for a boy but if there is no sign of puberty the time period lasts until
12.5 or 13.5 respectively. Any age younger is considered a child. This is the
time that fathers used to marry off their daughters.
6 But if her father disallows her in the day that he hears,
none of her vows, or of her bonds wherewith she hath bound her soul, shall
stand; and the LORD will forgive her, because her father disallowed her.
This is called good parenting.
7 And if she be married to a husband, while her vows are
upon her, or the clear utterance of her lips, wherewith she hath bound her
soul; 8 and her husband hear it,
whatsoever day it be that he hears it, and hold his peace at her; then her vows
shall stand, and her bonds wherewith she hath bound her soul shall stand.
Example: She had pain in childbirth and vowed
to have no more children and the husband wants a son. As I wrote this is for
Shalom Beis. From the Medrash: Once upon a time there was a big Posek whom all
the people in the area would come to ask questions in Halachos and Torah. His
wife made such a vow not to have any more children and wanted to take “Ikarim”
which either sterilizes or a birth control food. She disguised herself and
changed her voice when asking the question of the Ruv. He told her that a woman
was not obligated to have children only the husband. In such a case, he made a
Poskin as a neutral Rav against his own desire.
9 But if her husband disallows her in the day that he hears
it, then he shall make void her vow which is upon her, and the clear utterance
of her lips, wherewith she hath bound her soul; and the LORD will forgive her. 10 But the vow of a widow, or of her
that is divorced, even everything wherewith she hath bound her soul, shall
stand against her.
This is like the status of the daughters of
Zelphad mentioned last week.
11 And if a woman vowed in her husband's house, or bound her
soul by a bond with an oath, 12
and her husband heard it, and held his peace at her, and disallowed her not,
then all her vows shall stand, and every bond wherewith she bound her soul
shall stand. 13 But if her
husband makes them null and void in the day that he hears them, then whatsoever
proceeded out of her lips, whether it were her vows, or the bond of her soul,
shall not stand: her husband hath made them void; and the LORD will forgive
her. 14 Every vow, and every
binding oath to afflict the soul, her husband may let it stand, or her husband
may make it void. 15 But if her
husband altogether holds his peace at her from day to day, then he causes all
her vows to stand, or all her bonds, which are upon her; he hath let them
stand, because he held his peace at her in the day that he heard them. 16 But if he shall make them null and
void after that he hath heard them, then he shall bear her iniquity. 17 These are the statutes, which the
LORD commanded Moses, between a man and his wife, between a father and his
daughter, being in her youth, in her father's house.

31:1 And the LORD spoke unto Moses, saying: 2 'Avenge the children of Israel of
the Midianites; afterward shalt thou be gathered unto thy people.' 3 And Moses spoke unto the people,
saying: 'Arm ye men from among you for the war, that they may go against
Midian, to execute the LORD'S vengeance on Midian.
Balak was from Moav but Midian listened to the
disgusting advice of Balaam. They caused the death of 24,000 through their
fertility cult. Now they had to be punished.
4 Of every tribe a thousand, throughout all the tribes of
Israel, shall ye send to the war.' 5
So there were delivered, out of the thousands of Israel, a thousand of every
tribe, twelve thousand armed for war.
Their population was small so there was no
reason to call-up the whole army. 12,000 front line soldier, 12,000 in the
supply chain and 12,000 to pray.
6 And Moses sent them, a thousand of every tribe, to the
war, them and Phinehas the son of Eleazar the priest, to the war, with the holy
vessels and the trumpets for the alarm in his hand. 7 And they warred against Midian, as the LORD commanded Moses; and
they slew every male. 8 And they
slew the kings of Midian with the rest of their slain: Evi, and Rekem, and Zur,
and Hur, and Reba, the five kings of Midian; Balaam also the son of Beor they
slew with the sword.
Zur was a king and his daughter Kozbi a
princess. Balaam went home after he failed to curse the Bnei Yisrael but
perhaps tarried in Midian or returned to Midian when his advice killed 24,000
in order to reap his reward. Well HASHEM gave him his reward!
9 And the children of Israel took captive the women of
Midian and their little ones; and all their cattle, and all their flocks, and
all their goods, they took for a prey. 10
And all their cities in the places wherein they dwelt, and all their
encampments, they burnt with fire. 11
And they took all the spoil, and all the prey, both of man and of beast. 12 And they brought the captives, and
the prey, and the spoil, unto Moses, and unto Eleazar the priest, and unto the
congregation of the children of Israel, unto the camp, unto the plains of Moab,
which are by the Jordan at Jericho.
Under
normal convention of war at that time, the men were killed, women and children
taken captive.
13 And Moses, and Eleazar the priest, and all the princes of
the congregation, went forth to meet them without the camp. 14 And Moses was wroth with the
officers of the host, the captains of thousands and the captains of hundreds,
who came from the service of the war. 15
And Moses said unto them: 'Have ye saved all the women alive? 16 Behold, these caused the children
of Israel, through the counsel of Balaam, to revolt so as to break faith with
the LORD in the matter of Peor, and so the plague was among the congregation of
the LORD.
This was no ordinary war such as Sihon and Og.
This was a war ordered by HASHEM. It was the women who fought with their bodies
to kill the 24,000 by enticing them. Therefore, they deserve death and in
addition the seed is so rotten that even the male babies had to die.
17 Now therefore kill every male among the little ones, and
kill every woman that hath known man by lying with him. 18 But all the women children, that have not known man by lying
with him, keep alive for yourselves.
Any female under the age of three can be
educated in Torah and become a wife in the future.
19 And encamp ye without the camp seven days; whosoever hath
killed any person, and whosoever hath touched any slain, purify yourselves on
the third day and on the seventh day, ye and your captives.
Even though they are not on the level of Tuma
of a dead Ben Yisrael, they did have uncleanliness and one had to go to the
Mikva for purity.
20 And as to every garment, and all that is made of skin, and
all work of goats' hair, and all things made of wood, ye shall purify.'

21 And Eleazar the priest said unto the men of war that went
to the battle: 'This is the statute of the law which the LORD hath commanded
Moses: 22 Howbeit the gold, and
the silver, the brass, the Miron, the tin, and the lead,
These are common metals three are more precious
than the others and easy to mine for the ancients.
23 everything that may abide the fire, ye shall make to go
through the fire, and it shall be clean; nevertheless, it shall be purified
with the water of sprinkling; and all that abides not the fire ye shall make to
go through the water.
Metals could be heated red hot and koshered
similar to the process making wrought iron. Clothing and other items had to be
washed in a Mikva of sorts.
24 And ye shall wash your clothes on the seventh day, and ye
shall be clean, and afterward ye may come into the camp.'
You came in contact with the dead.
25 And the LORD spoke unto Moses, saying: 26 'Take the sum of the prey that was
taken, both of man and of beast, thou, and Eleazar the priest, and the heads of
the fathers' houses of the congregation; 27 and divide the prey into two parts: between the men skilled in
war, that went out to battle, and all the congregation; 28 and levy a tribute unto the LORD of the men of war that went
out to battle: one soul of five hundred, both of the persons, and of the
beeves, and of the asses, and of the flocks; 29 take it of their half, and give it unto Eleazar the priest, as
a portion set apart for the LORD. 30
And of the children of Israel's half, thou shalt take one drawn out of every
fifty, of the persons, of the beeves, of the asses, and of the flocks, even of
all the cattle, and give them unto the Levites, that keep the charge of the
tabernacle of the LORD.'
Fifty percent went to the Mishkan.
31 And Moses and Eleazar the priest did as the LORD commanded
Moses. 32 Now the prey, over and
above the booty which the men of war took, was six hundred thousand and seventy
thousand and five thousand sheep, 33
and threescore and twelve thousand beeves, 34 and threescore and one thousand asses, 35 and thirty and two thousand persons in all, of the women that
had not known man by lying with him.
Only female children from the age of 3 and
below were spared.
36 And the half, which was the portion of them that went out
to war, was in number three hundred thousand and thirty thousand and seven
thousand and five hundred sheep. 37
And the LORD'S tribute of the sheep was six hundred and threescore and fifteen.
38 And the beeves were thirty
and six thousand, of which the LORD'S tribute was threescore and twelve. 39 And the asses were thirty thousand
and five hundred, of which the LORD'S tribute was threescore and one. 40 And the persons were sixteen
thousand, of whom the LORD'S tribute was thirty and two persons.
The tribes in turn took one twelfth and the
females were either given to childless couples (since the people were blessed
there might not have been) or taken for slaves or servants or future wives for
members of the tribes. I assume that every living born Jew today has some DNA from
these females in them. I know that
many people were troubled why the male children were not kept alive. Especially
in lieu of the holocaust. However, there must have been something spiritually
and genetically wrong with the males that HASHEM ordered their expiration. The
same genetics exist among Amalek. There are some things that don’t look fair to
us in this world but HASHEM sees before birth and beyond the grave and we don’t.
41 And Moses gave the tribute, which was set apart for the
LORD, unto Eleazar the priest, as the LORD commanded Moses. 42 And of the children of Israel's
half, which Moses divided off from the men that warred. …49 and they said unto Moses: 'Thy
servants have taken the sum of the men of war that are under our charge, and
there lacked not one man of us.
We see this was a miraculous war. For
unfortunately in most wars even from the victorious some soldiers die.
50 And we have brought the LORD'S offering, what every man
hath gotten, of jewels of gold, armlets, and bracelets, signet-rings,
ear-rings, and girdles, to make atonement for our souls before the LORD.' 51 And Moses and Eleazar the priest
took the gold of them, even all wrought jewels. 52 And all the gold of the gift that they set apart for the LORD,
of the captains of thousands, and of the captains of hundreds, was sixteen
thousand seven hundred and fifty shekels.-- 53 For the men of war had taken booty, every man for himself.-- 54 And Moses and Eleazar the priest
took the gold of the captains of thousands and of hundreds, and brought it into
the tent of meeting, for a memorial for the children of Israel before the LORD.
The command is you should not murder. However,
these soldiers killed as commanded by HASHEM. For killing in the name of the
nation and defense, they still had to make atonement.
32:1 Now the children of Reuben and the
children of Gad had a very great multitude of cattle; and when they saw the
land of Jazer, and the land of Gilead, that, behold, the place was a place for
cattle, 2 the children of Gad
and the children of Reuben came and spoke unto Moses, and to Eleazar the
priest, and unto the princes of the congregation, saying: 3 'Ataroth, and Dibon, and Jazer, and
Nimrah, and Heshbon, and Elealeh, and Sebam, and Nebo, and Beon, 4 the land which the LORD smote before
the congregation of Israel, is a land for cattle, and thy servants have
cattle.'
The Golan Heights and the other side of
the upper Jordan River Valley are rich lands and by the river or on the heights
there are planes and good water for the cattle to drink.
5 And they said: 'If we have found
favor in thy sight, let this land be given unto thy servants for a possession;
bring us not over the Jordan.' 6
And Moses said unto the children of Gad and to the children of Reuben: 'Shall
your brethren go to the war, and shall ye sit here? 7 And wherefore will ye turn away the heart of the children of Israel
from going over into the land which the LORD hath given them? 8 Thus did your fathers, when I sent
them from Kadesh-Barnea to see the land. 9 For when they went up unto the valley of Eshcol, and saw the
land, they turned away the heart of the children of Israel, that they should
not go into the land which the LORD had given them. 10 And the LORD'S anger was kindled in that day, and He swore,
saying: 11 Surely none of the
men that came up out of Egypt, from twenty years old and upward, shall see the
land which I swore unto Abraham, unto Isaac, and unto Jacob; because they have
not wholly followed Me; 12 save
Caleb the son of Jephunneh the Kenizzite, and Joshua the son of Nun; because
they have wholly followed the LORD. 13
And the LORD'S anger was kindled against Israel, and He made them wander to and
fro in the wilderness forty years, until all the generation, that had done evil
in the sight of the LORD, was consumed. 14
And, behold, ye are risen up in your fathers' stead, a brood of sinful men, to
augment yet the fierce anger of the LORD toward Israel. 15 For if ye turn away from after Him, He will yet again leave
them in the wilderness; and so ye will destroy all this people.'
As Shakespeare wrote in Julius Caesar “You
too Brutus!”. After 40 years are you going to virtually stab us in the back
that again we will not enter the land?
16 And they came near unto him, and
said: 'We will build sheepfolds here for our cattle, and cities for our little
ones;
We will build pens and fences for our
animals to protect them from wild beasts. We will fortify cities for our
families.
17 but we ourselves will be ready
armed to go before the children of Israel, until we have brought them unto
their place; and our little ones shall dwell in the fortified cities because of
the inhabitants of the land. 18
We will not return unto our houses, until the children of Israel have inherited
every man his inheritance. 19
For we will not inherit with them on the other side of the Jordan, and forward,
because our inheritance is fallen to us on this side of the Jordan eastward.'
We will fight on the
front lines and only return when the land is conquered for our brethren.
20 And Moses said unto them: 'If ye
will do this thing: if ye will arm yourselves to go before the LORD to the war,
21 and every armed man of you
will pass over the Jordan before the LORD, until He hath driven out His enemies
from before Him, 22 and the land
be subdued before the LORD, and ye return afterward; then ye shall be clear
before the LORD, and before Israel, and this land shall be unto you for a
possession before the LORD.
This is your contract with us and HASHEM
and acceptable.
23 But if ye will not do so, behold,
ye have sinned against the LORD; and know ye your sin which will find you.
HASHEM has ways of dealing with those who
violate contracts and will deal with you in kind.
24 Build you cities for your little
ones, and folds for your sheep; and do that which hath proceeded out of your
mouth.' … 39 And the children of Machir the son
of Manasseh went to Gilead, and took it, and dispossessed the Amorites that
were therein. 40 And Moses gave
Gilead unto Machir the son of Manasseh; and he dwelt therein. 41 And Jair the son of Manasseh went
and took the villages thereof, and called them Havvoth-jair. 42 And Nobah went and took Kenath, and
the villages thereof, and called it Nobah, after his own name.
After seeing that Reuven and Gad was
acceptable before HASHEM, half of the tribe of Menashe would settle on the
lower Golan Heights and fields on the other side of the Yarden.
This Shabbos we announce the month of Menachem Av
that will be observed on Thursday night and Friday. As Av comes in mourning
increases.
Making
peace in heaven by Rabbi Yerachmiel Tilles
"To what better purpose can I use my riches than to have a Torah
scroll written?" thought the wealthy Reb Meir to himself. From that day on
he busied himself in his grand project which he executed carefully in all its
details. At first he bought the animals which were to provide the parchment for
the scroll. These he had carefully slaughtered and the meat thereof distributed
among the poor. The hides were then sent to a tanner to be cured and prepared
for parchment.
Next Reb Meir sought a G-d-fearing sofer (scribe) to do the major job.
"You will concentrate only upon this work," he stipulated, "in
return for which I will pay you a weekly salary to sustain you and your family
for as long as it takes to complete the job. Take your time, purify your mind
and body before each writing session, but produce a perfect Torah scroll."
The scribe agreed and entered the employ of Reb Meir for eight years,
during which he worked exclusively upon the scroll. When he finished, Reb Meir
made preparations for a huge feast to dedicate his new acquisition.
The celebration was to include most of the local population, crowned by
all the notables. Reb Meir arranged to provide for their comfort by hiring
waiters to cater to their individual needs. Among them was Chayim, known by all
as "the Tehilim reciter."
Chayim the Psalms Sayer was a simple man, unlearned but sincere and G-d
fearing. He had earned his title through his recital of psalms, which never
left his lips from morning to night. To earn his livelihood he worked as a
water-carrier and at this celebration Chayim was to perform his usual task,
that is, to bring water for hand-washing and in addition to serve drinks of all
sorts.
The party began in the late afternoon. While the celebrants awaited the
evening prayer to begin they partook of sweets and drinks, for the main feast
would commence only after Maariv. Chayim was there, circulating among the
guests with trays and alcoholic beverages, imbibing himself from time to time.
Soon, all the guests arose and went into an adjoining room to davven
(pray) while the tables were prepared for the meal. The relatively short prayer
was over quickly, whereupon the guests drifted back in and took their places.
An air of gaiety and warmth filled the hall, for this was the grand climax of
eight years of expectancy, of work and expense, now culminating with a feast in
honor of the Torah.
The guests sat down and waited for water to be provided for washing
their hands. Reb Meir looked around but couldn't find Chayim, whose job it was
to provide the washing water and vessels. He was nowhere to be found. Reb Meir
searched in adjoining rooms for the missing waiter, upset that things were not
going as smoothly as he had so carefully planned. He finally discovered him
curled up in the cloakroom, fast asleep in a drunken stupor.
"What chutzpa is this!" he reprimanded his waiter as he
grabbed him by the collar and shook him vigorously. "Here you are drunk on
my liquor, shirking your duties. You should have stayed at home if you can't be
relied on. All my guests are being kept waiting for the meal to begin while you
calmly curl up and fall asleep."
Reb Meir raised his voice louder and louder while shaking his employee
roughly, then dragging him towards the main dining hall until the latter had
thoroughly shaken off his drunkenness.
Finally the water-carrier was able to get a word in and he made his
plaintive apologies, "Sir, you said that the party was for all of us and
that we were to feel free to partake of the food and drink too. I simply did
not realize how strong your shnaps was, not being accustomed to such quality
spirits. Before I knew it I fell asleep. Please don't shame me before all these
people. I am thoroughly awake and will fulfill my duties as a waiter."
The host left the abashed waiter to his work and went to sit among his
important guests. He hadn't been seated for five minutes before his attention
was diverted.
"Sir, an important person awaits you outside. He says he won't keep
you long but what he has to say is urgent." Reb Meir got up and followed
his servant outside reluctantly. A well-dressed stranger asked to have a few
words with him.
"Come, sit in my carriage just for a moment, please," urged
the stranger. Reb Meir obliged and sat half in, half out, waiting impatiently.
Suddenly before he could bat an eyelash, he found himself transported to a deep
wood which he realized was many many miles away from home. He stood on the
strange road in his light indoor clothes not knowing which way to turn.
"What has happened to me?" he wondered dazedly. "And why?"
As the cold that began penetrating his bones also cleared his mind, he
perceived a light from afar. He drew closer and had to rub his eyes in
surprise; a magnificent palace stood in a clearing. Reb Meir entered the
spacious hall which led into a huge, brilliantly lit chamber. He went over to
the stove to warm himself. None of the people there paid him any attention.
However, when an old man with a snowy white beard entered shortly afterwards,
he received a warm welcome.
"Peace unto you. Avraham Avinu ('our father Abraham'),"
exclaimed the people seated at the table. The venerable man took his place to
be soon joined by another and then another. Each succeeding sage was greeted in
turn, "Welcome, Yitzchak Avinu," and "Welcome, Yaakov
Avinu,' etc., until the last expected guest took his place. When he arose,
everyone became quiet and turned to face him.
"I have a complaint against the man over there by the stove,"
he announced. All eyes turned to Reb Meir. "This person shamed the Psalms
Sayer in public. I demand retribution, for it is as if he had shamed my holy
tehilim which possess the power to abolish evil decrees, heal the sick, and
bring balm to troubled souls."
"This man must be judged," agreed the seated people. "He
must pay for his wicked deed." They discussed what should be the suitable
punishment, and a speedy verdict of death resulted for Reb Meir.
"One moment," called out Dovid HaMelech (King David),
rising once again. "Are we not defeating the purpose of the judgment?
Would it not be preferable for this man to exonerate himself by his own deeds?
Rather, let him return to the scene of the sin and expiate it by a public
confession. Let him attest to the importance of saying psalms by relating this
episode to all his guests."
"Your suggestion is wise," one man spoke up." But I have
another score to settle with him first. I demand to know why this man, who
lives right in my city, in Mezibuz, has never visited me before nor invited me
to his Torah celebration. If he is allowed to return home will he rectify this
sin of omission?"
This was the Baal Shem Tov
who had been present all the while among the rest of the spectators, but until
this moment had not uttered a word. Reb Meir was called upon to express his
view about this second charge against him. He heartily agreed to amend his
wrongdoing. Suddenly he found himself in the same coach, which immediately
spirited him back to his home.
Reb Meir stood shivering in front of his house. He paused. It seemed as
if eons had passed since he last stood there, yet when he entered he saw the
festivities were at exactly the same point as when he had left them. It must be
that only a few moments had passed!
Reb Meir loudly asked for everyone's attention and then announced,
"I beg you all to wait patiently for me. There is an important guest whom
I must bring to tonight's celebration. I will return shortly."
Reb Meir ran quickly to the Baal Shem Tov's beis medrash
(Torah-study hall) and saw the very man who had spoken against him during the
strange scene in the forest. He begged the Besht to forgive him and join him at
the feast. The Besht forgave him wholeheartedly.
They hurried back to Reb Meir's home, where once again Reb Meir demanded
everyone's attention. He told his strange story, and then called Chayim the
Psalms Sayer to stand next to him. In the presence of the entire assembly, he
begged the water-carrier to forgive and forget the shameful treatment he had
been subject to.
The Baal Shem Tov spoke after him, adding some words about the
importance of reciting tehilim, and all present felt that the celebration had
taken on a more meaningful tone.

I feel sorry for Robert Mueller and his poor wife.
I viewed a man with geriatric memory problems. I saw excerpts of his testimony
it was one big senior moment. He could not remember who appointed him. It was
quite obvious to me that he was a figure head administrator and did not write
or even was familiar with the contents of the “Mueller Report”. I have seen too
many people younger and older than I with senior moments and in my opinion
