 Parsha Mishpatim

 

 

Last week, we had Moshe judging people and the Decalogue. This week we continue with the laws of damages and between man and his fellow.

21:1 Now these are the ordinances which thou shalt set before them. 2 If thou buy a Hebrew servant, six years he shall serve; and in the seventh he shall go out free for nothing. 

 

The Jewish ‘Slave’ or servant was sold into slavery by the Beit Din for he either stole something or was in debit. His maximum servitude is six years and he goes free in the seventh. He receives worker’s compensation enough for bedding, utensils and to tide him over for the Shmita year. He can be freed to marry the daughter of the rich man.

 

3 If he come in by himself, he shall go out by himself; if he be married, then his wife shall go out with him. 

 

If he was married when he was sold by Beit Din or himself, then his wife and children go out with him.

 

4 If his master give him a wife, and she bear him sons or daughters; the wife and her children shall be her master's, and he shall go out by himself. 

 

If he was given a non-Jewish slave/servant as a wife she essentially is owned by the master.

 

5 But if the servant shall plainly say: I love my master, my wife, and my children; I will not go out free; 6 then his master shall bring him unto God, and shall bring him to the door, or unto the door-post; and his master shall bore his ear through with an awl; and he shall serve him forever. 

 

Forever means until the Yovel when Liberty is proclaimed throughout the land. The ear that heard on Sinai I am the L-RD your Master is drilled to the Mezuzah as it did not want to be free. Now the man can purchase is non-Jewish Slave Wife and free her and the children and they automatically become Jews as they were dipped in the Mikvah after internment.

 

7 And if a man sell his daughter to be a maid-servant, she shall not go out as the men-servants do. 

 

Unlike a male servant, the female goes out upon reaching either puberty or 12years and one day old aka her 12th birthday on the Hebrew Calendar.

 

8 If she please not her master, who hath espoused her to himself, then shall he let her be redeemed; to sell her unto a foreign people he shall have no power, seeing he hath dealt deceitfully with her. 

 

The rich man either took her for a second wife for himself from a poor family of good breeding such as a Cohain, Levi or poor Talmud Chacham. Now either he or his son is not interested in her. She shall be set free and the money in which he bought her service remains by her family.

 

9 And if he espouse her unto his son, he shall deal with her after the manner of daughters. 10 If he take him another wife, her food, her raiment, and her conjugal rights, shall he not diminish. 

 

She has her Ketuvah and Nuptial rights like any Jewish Wife rich or poor.

 

11 And if he do not these three unto her, then shall she go out for nothing, without money. 

 

She came in poor, she goes out poor but her family had money to breathe by.

 

12 He that smites a man, so that he dies, shall surely be put to death. 

 

This is the case of a planned murder but in a case of a fight between two men, one would have to watch out for the avengers of blood.

 

13 And if a man lie not in wait, but God cause it to come to hand; then I will appoint thee a place whither he may flee. 

 

Here is the case of accidental manslaughter via some accident like going up a ladder carrying bricks and one falls upon a person walking below or an axe head flying off and killing somebody in the vicinity. In the case of negligent manslaughter such as going down the ladder with bricks and not calling out to passer byes one cannot take refuge a more modern case would be not maintaining ones tires or brakes.

 

14 And if a man come presumptuously upon his neighbor, to slay him with guile; thou shalt take him from Mine altar, that he may die.

 

If a Cohain has murdered somebody, he shall be removed to be tried by the Sanhedrin. (See Shlomo HaMelech and the slaying of Yoav because of the murder of Avner Ben Ner.)

 

15 And he that smites his father, or his mother, shall be surely put to death. 

 

This case is that he causes one or both to bleed. Allowing them to live would allow rebellion in society against all authority. It is more than just Honor thy father and mother.

 

16 And he that steals a man, and sells him, or if he be found in his hand, he shall surely be put to death. 

 

This is “Thou Shall not steal” of the Decalogue.

 

17 And he that curses his father or his mother, shall surely be put to death. 

 

Not a curse like ‘drop dead’ or ‘go to hell’ which is bad enough but using THE NAME to   curse his parents.

 

18 And if men contend, and one smite the other with a stone, or with his fist, and he die not, but keep his bed; 19 if he rise again, and walk abroad upon his staff, then shall he that smote him be quit; only he shall pay for the loss of his time, and shall cause him to be thoroughly healed. 

 

Compensation for pain, healing medicines, doctor, loss of work and embarrassment at his state of health. The words “the doctor shall heal is in the Pasuk” and our Sages say that HASHEM gives a doctor in each generation the power to heal.

 

… 22 And if men strive together, and hurt a woman with child, so that her fruit depart, and yet no harm follow, he shall be surely fined, according as the woman's husband shall lay upon him; and he shall pay as the judges determine. 23 But if any harm follow, then thou shalt give life for life, 24 eye for eye, tooth for tooth, hand for hand, foot for foot, 25 burning for burning, wound for wound, stripe for stripe. 

 

All these are fines and for the woman losing a child, psychological damage.

 

26 And if a man smite the eye of his bondman, or the eye of his bondwoman, and destroy it, he shall let him go free for his eye's sake. 27 And if he smite out his bondman's tooth, or his bondwoman's tooth, he shall let him go free for his tooth's sake. 

 

He goes free but he has lost an eye or a tooth.

 

28 And if an ox gore a man or a woman, that they die, the ox shall be surely stoned, and its flesh shall not be eaten; but the owner of the ox shall be quit. 

 

This is the case of a tame Ox that escaped.

 

29 But if the ox was wont to gore in time past, and warning hath been given to its owner, and he hath not kept it in, but it hath killed a man or a woman; the ox shall be stoned, and its owner also shall be put to death. 

 

The only solution for an Ox that gores is the knife and if the owner did not slaughter him for meat it is not negligent homicide but tantamount to out and out first degree murder per the Torah.

 

30 If there be laid on him a ransom, then he shall give for the redemption of his life whatsoever is laid upon him. 31 Whether it have gored a son, or have gored a daughter, according to this judgment shall it be done unto him. 32 If the ox gore a bondman or a bondwoman, he shall give unto their master thirty shekels of silver, and the ox shall be stoned. 

 

This is the case of a slave.

 

33 And if a man shall open a pit, or if a man shall dig a pit and not cover it, and an ox or an ass fall therein, 34 the owner of the pit shall make it good; he shall give money unto the owner of them, and the dead beast shall be his. 

 

We assume that some caution was put up that humans did not fall into the pit but the dumb animal died because the caution was not strong enough to prevent his falling into the the pit.

 

35 And if one man's ox hurt another's, so that it dies then they shall sell the live ox, and divide the price of it; and the dead also they shall divide. 36 Or if it be known that the ox was wont to gore in time past, and its owner hath not kept it in; he shall surely pay ox for ox, and the dead beast shall be his own. 

 

All these laws of damages are in Tractate Baba Kama and Chosen Mishpat Shulchan Aruch.

 

37 If a man steal an ox, or a sheep, and kill it, or sell it, he shall pay five oxen for an ox, and four sheep for a sheep.

 

With such a high fine, one would not go cattle or sheep rustling but if they did, they would should be fined heavily.

 

22:1 If a thief be found breaking in, and be smitten so that he dies, there shall be no bloodguiltiness for him. 

 

If one confront a thief and kill him in his trespass, the person who does so is innocent as the neither knew if the thief was armed, a possible strong person who might murder him, etc.

 

2 If the sun be risen upon him, there shall be bloodguiltiness for him--he shall make restitution; if he have nothing, then he shall be sold for his theft. 

 

This is one of the ways a person becomes a Hebrew slave/servant.

 

3 If the theft be found in his hand alive, whether it be ox, or ass, or sheep, he shall pay double. 

 

Rustling Animals will cost the thief double even if it is alive in such a way that will put the rustlers out of business not to mention those who slaughter the animals or it dies because of their rustling being four or five times the price stated above.

 

4 If a man cause a field or vineyard to be eaten, and shall let his beast loose, and it feed in another man's field; of the best of his own field, and of the best of his own vineyard, shall he make restitution. 5 If fire break out, and catch in thorns, so that the shocks of corn, or the standing corn, or the field are consumed; he that kindled the fire shall surely make restitution. 

 

The Torah has now defined 4 types of damages. The living moving Ox running wild and goring, the eating and trampling of flowers and crops by one’s animal, the pit in a public domain and the fire that can move from place to place to cause damage. The Talmud states that the pit is inanimate but waiting for the accident to happen, the fire is inanimate but can move from place to place causing the damage. The Ox is animate can gore or eat/trample to cause damage.

 

6 If a man deliver unto his neighbor money or stuff to keep, and it be stolen out of the man's house; if the thief be found, he shall pay double. … 9 If a man deliver unto his neighbor an ass, or an ox, or a sheep, or any beast, to keep, and it die, or be hurt, or driven away, no man seeing it; 10 the oath of the LORD shall be between them both, to see whether he have not put his hand unto his neighbor's goods; and the owner thereof shall accept it, and he shall not make restitution. … 12 If it be torn in pieces, let him bring it for witness; he shall not make good that which was torn. 13 And if a man borrow aught of his neighbor, and it be hurt, or die, the owner thereof not being with it, he shall surely make restitution. 14 If the owner thereof be with it, he shall not make it good; if it be a hireling, he loses his hire. 

 

These are various laws of damage to property.

 

15 And if a man entice a virgin that is not betrothed, and lie with her, he shall surely pay a dowry for her to be his wife. 16 If her father utterly refuse to give her unto him, he shall pay money according to the dowry of virgins. 

 

This is damage to a person. The word entice or persuade is used and sometimes young men and young women go a bit too far in what should have been platonic love.

 

17 Thou shalt not suffer a sorceress to live. 18 Whosoever lies with a beast shall surely be put to death.  19 He that sacrifices unto the gods, save unto the LORD only, shall be utterly destroyed. 

 

For these sins if there are witnesses carry the death penalty.

 

20 And a stranger shalt thou not wrong, neither shalt thou oppress him; for ye were strangers in the land of Egypt. 

 

You were oppressed because you were strangers in Egypt. Don’t behave as such.

 

21 Ye shall not afflict any widow, or fatherless child. 22 If thou afflict them in any wise--for if they cry at all unto Me, I will surely hear their cry-- 23 My wrath shall wax hot, and I will kill you with the sword; and your wives shall be widows, and your children fatherless. 

 

Taking advantage of a widow or fatherless person gets the wrath of g-D.

 

24 If thou lend money to any of My people, even to the poor with thee, thou shalt not be to him as a creditor; neither shall ye lay upon him interest. 25 If thou at all take thy neighbor's garment to pledge, thou shalt restore it unto him by that the sun goes down; 26 for that is his only covering, it is his garment for his skin; wherein shall he sleep? and it shall come to pass, when he cries unto Me, that I will hear; for I am gracious. 

 

If you lend anything to a ‘dirt-poor’ person take into account that the loan may never be paid back. So that if the person cannot pay it back, you write it off as charity money.

 

27 Thou shalt not revile God, nor curse a ruler of thy people. 

 

Do not rebel against authority for the ruler is upon you because of your or the people’s behavior.

 

23:1 Thou shalt not utter a false report; put not thy hand with the wicked to be an unrighteous witness. 2 Thou shalt not follow a multitude to do evil; neither shalt thou bear witness in a cause to turn aside after a multitude to pervert justice; 3 neither shalt thou favour a poor man in his cause. 4 If thou meet thine enemy's ox or his ass going astray, thou shalt surely bring it back to him again. 

 

Since your neighbor or even your ‘enemy’ is a Jew you are still related and therefore treat him that way.

 

… 10 And six years thou shalt sow thy land, and gather in the increase thereof; 11 but the seventh year thou shalt let it rest and lie fallow, that the poor of thy people may eat; and what they leave the beast of the field shall eat. In like manner thou shalt deal with thy vineyard, and with thy oliveyard. 12 Six days thou shalt do thy work, but on the seventh day thou shalt rest; that thine ox and thine ass may have rest, and the son of thy handmaid, and the stranger, may be refreshed. 

 

Again we are reminded of the Shmita Year and the holiness of Shabbos. It seems that the Yetzer HaRa works overtime to belittle and detract from the importance and holiness of Shabbos. Not to mention that one’s soul gets Kares in both this and the next world for violating Shabbos Kodesh. One thing is like over-eating and a moment on your lips could be a lifetime on your hips. But destroying ones holy soul the IMAGE in which we were created by violating the laws of rest on Shabbos seems quite silly.

 

…14 Three times thou shalt keep a feast unto Me in the year. 15 The feast of unleavened bread shalt thou keep; seven days thou shalt eat unleavened bread, as I commanded thee, at the time appointed in the month Abib--for in it thou came out from Egypt; and none shall appear before Me empty; 16 and the feast of harvest, the first-fruits of thy labors, which thou sow in the field; and the feast of ingathering, at the end of the year, when thou gather in thy labors out of the field. 17 Three times in the year all thy males shall appear before the Lord GOD. 

 

A reminder of the three festivals.

 

… Thou shalt not seethe a kid in its mother's milk. 

 

The first of three times this is mentioned in Torah regarding forbidden mixing of food.

 

20 Behold, I send an angel before thee, to keep thee by the way, and to bring thee into the place which I have prepared. 21 Take heed of him, and hearken unto his voice; be not rebellious against him; for he will not pardon your transgression; for My name is in him. 22 But if thou shalt indeed hearken unto his voice, and do all that I speak; then I will be an enemy unto thine enemies, and an adversary unto thine adversaries. 

 

You should observe the festivals.

 

… 3 And Moses came and told the people all the words of the LORD, and all the ordinances; and all the people answered with one voice, and said: 'All the words which the LORD hath spoken will we do.' … 16 And the glory of the LORD abode upon mount Sinai, and the cloud covered it six days; and the seventh day He called unto Moses out of the midst of the cloud. 17 And the appearance of the glory of the LORD was like devouring fire on the top of the mount in the eyes of the children of Israel. 18 And Moses entered into the midst of the cloud, and went up into the mount; and Moses was in the mount forty days and forty nights.

 

 

This week is Parsha Shekelim Shemos 30:11-16

 

 

In honor of Rosh Chodesh Adar, I would like to bring a little joy during the Covid Crises and Adar is a month for Mirth.

 

It is a Mitzvah not to be a “baal tashchit” or a person who destroys things like nature. Rivers and Streams should be pristine and those who picnic should police the area and clean up their garbage and douse their fires (which are forbidden by the Torah as well as manmade environmental laws during windy and hot days).

 

Without men roaming the streets there has become in Israel a wild life problem. Wild Boars (not hunted by Jews or Arabs) have begun running around Haifa and in my Yeshuv, we had to have Christian Licensed Hunters take out their population. With less cars on the roads, jackals have started crossing the roads into civilized areas and the garbage cans that the Boars have knocked over have become a food sources for them too. Unfortunately, some of them are carrying Rabies.

 

In Israel, the solar water heaters save energy and in some cases solar panels pay to put up. There is a problem with electric cars. They are only efficient with a certain mileage or kilometer use per year. They also follow the laws of Sir Isaac Newton in that a certain amount of energy is required to move the car.

 

One who sees, lightning, mountains, deserts, the Dead Sea says the blessing “Oseh Maaseh Beresheis. One who sees a great Sea without ‘end’ says “Who has made the great sea”. One who sees on his way to the Dead Sea a Camel should say “Who made changes in creatures”. Some Rabbis used to visit zoos to say this Bracha.

 

So as the Spring comes on go out celebrate nature and the environment.

 

 

Four Things I learned from Tom Brady by Rabbi Tzvi Nightingale

The greatest of all time can teach us a thing or two what it is to surpass expectations and obtain unimaginable success.

 

Google the term “GOAT” – Greatest of All Time – and Tom Brady shows up more than anyone else. More than Michael Jordan, Muhammad Ali, Serena Williams or Wayne Gretzky – all GOATS in their own right.

 

Brady returns to the Super Bowl for the tenth time – nobody has ever come even close to that – and for a chance to win a seventh Super Bowl ring. Here are four lessons we can learn from the GOAT among GOATs.

 

Learn to adapt. After spending 20 years with the New England Patriots, for the first time in his career Brady is playing on a different team, the Tampa Bay Buccaneers. Brady epitomizes the truth that if you are good at something and have the flexibility to adjust, it doesn’t make a difference what setting you are in.

 

Here is a man with a different team – a different front-line protecting him, different receivers, different running backs, and different playing conditions – the heat of Tampa versus the frigid cold of New England – and yet he still succeeds. Somehow all these changes have not stopped him from rising to the top once again.

 

How often do we attribute our lack of success to being in an environment that we’re not used to? Of blaming exterior factors to our inability to achieve?

 

Brady had every excuse in the world to fail to reach the Super Bowl, especially missing Coach Bill Belichik, but he didn’t take them. All he did was continue his leadership and skill in a completely new setting and team. He worked with a whole new collection of mates to produce the same result – winning.

 

Poise. When I was watching the NFC championship game between the Green Bay Packers and Tampa, I was amazed at how calm, cool and collected Brady was. He still stands in the pocket completely composed. His perfect passes that float through the air seem effortless in their delivery.

 

The Talmud says that, “Anyone who tries to force time, time forces him. But anyone who yields to time, time stands still for him.” Ever notice how this is true with all great sports figures? They seem to operate, not at a faster pace than everyone else, but actually at a slower one. Brady, Gretzky, Federer – they are always so unruffled and their movements so even, graceful and elegant.

 

We also experience this when we get into the “zone” and reach a state of flow where time seems to stand still. Everything slows down when we don’t force time but instead “be in the moment” as they say.

 

Family: Some very successful people achieve their huge accomplishments at the expense of having no personal or family life. Their family is often sacrificed on the altar of getting ahead in their field (or on the field). Not so with Brady.

 

After spending days with Tom Brady in the Bahamas, Ben Court wrote in Men’s Health magazine: "He would be the first to tell you that there is no more or less to his reality right now than the sport of football and his family. Whenever Brady talks about his family, which he does easily and without prompting, he comes to life, waving those long arms and breaking into laughter as he describes how each of his kids delights him."

 

Judaism has always recognized that the most important institution to society’s well being is the family. We have mechanisms not to fall into the trap of forgetting family for career. Shabbat, Jewish holidays, and lifecycle events ensure that we not lose sight of the supreme importance of our loved ones.

 

Brady may not make Kiddush every week, but maybe his old boss, Robert Kraft conveyed to him this basic Jewish tenet.

 

And finally…

 

Never stop believing in yourself – or in another. Cliché? Maybe, but it’s certainly true in Brady’s case. Brady was not born into greatness, he earned it. He was cut from the varsity team in high school, he had to fight for playing time in college, and 198 other players were picked ahead of him in the draft, six of whom were quarterbacks. (Those other six teams kick themselves till this day.) He had ample opportunity to mope or feel sorry for himself and pack it all in. But he didn’t.

 

And at the age when most people would just retire and hang up their jersey, Brady didn’t listen to the naysayers who said it was time to go. And look where that led him – playing in his tenth Super Bowl game.

 

Ethics of our Fathers states, “Do not look down upon anyone for everybody has their hour.” Everyone has their time, it’s just that for some it arrives later, and usually when no one else is noticing.

 

And so it goes, the underdog, the overlooked, the dark horse –so often they become the heroes and winners and take center stage. If quiet, composed, unobtrusive Tom Brady can become the GOAT at what he does, so can we. By embodying the same principles in life we too can hold our trophy high when the Almighty helps us succeed.

 

 

 

 

The Orthodox Jewish Government Official Accused of Dual Loyalty.

The Biden Administration had to defend one of its senior appointees from smears in the press that has been called “anti-Semitic.”

 

Last month President Biden created a new position, Deputy National Security Advisor for Cyber and Emerging Technology, and tapped Anne Neuberger, a proud Orthodox Jewish woman, to lead it. Ms. Neuberger – who also goes by her Hebrew name Chani – grew up in a Chassidic Jewish area of Brooklyn and attended Orthodox Jewish Beis Yaakov girls’ schools.

 

After the terror attacks on September 11, 2001, Ms. Neuberger left a career in the private sector and dedicated herself to government service. She previously worked for the US National Security Agency (NSA) as Director of Cybersecurity. In her new role with the Biden administration, she coordinates cybersecurity across the entire US Federal Government.

 

Pres. Biden declared Neuberger “will be integral in keeping the American people safe and building capacity to prepare for and respond to the full spectrum of threats we face – from cyber intrusions to grid attacks, from possible future pandemics to deliberate acts of terror.”

 

After Ms. Neuberger’s appointment to the Biden administration, the magazine Mother Jones ran a spurious article about her family's private charitable foundation, seizing on the fact that Anne and her husband Yehudah had made a sizable donation to the American Israel Public Affairs Committee (AIPAC). The magazine highlighted the fact that Israel is a “cybersecurity powerhouse” – as if supporting a strong US-Israel relationship somehow represented a conflict of interest for Ms. Neuberger. The donation, the magazine falsely claimed, would “raise a lot of eyebrows.” NBC picked up the appalling story, amplifying this baseless claim.

 

In reality, supporting AIPAC doesn’t raise any eyebrows at all. AIPAC is a bipartisan organization that advocates for a strong US-Israel relationship. Pres. Joe Biden and Vice President Kamala Harris have each spoken at AIPAC events, as did former Pres. Donald Trump and Vice President Mike Pence. It’s outrageous to claim, as Mother Jones and NBC did, that Ms. Neuberger’s supports of a strong US-Israel relationship is somehow sinister and un-American.

 

NBC issued an editor’s note saying the story “fell short of reporting standards” and retracted their smears. Mother Jones refused to back down, and its baseless allegations against Ms. Neuberger continue to exist, polluting the internet.

 

Ms. Neuberger, meanwhile, continues to perform her vital work, undeterred and undistracted, keeping American citizens safe from foreign attack. Someone ought to tell the reporters at Mother Jones that that’s what loyalty, integrity, and patriotism truly looks like.

 

Ms. Neuberger knows the threats that foreign attacks and surveillance can bring. Her four grandparents are Holocaust survivors, and her father grew up in Communist Hungary. She grew up hearing stories of the dangers her parents and grandparents faced. “Dreaming of those freedoms brought my family to this country,” she explained, motivating her for government service.

 

That traumatic family history informs Ms. Neuberger’s commitment to her Jewish faith. She told National Public Radio “There was a deep sense among my grandparents that their parents had been killed for their faith, and they had an obligation to bring up a generation (for whom) that faith and that tradition was meaningful – and to recreate it in these kids who were proving that Hitler had not been successful at eradicating this commitment to faith.”

 

In 1976, Ms. Neuberger’s family faced more deadly violence because they were Jews: her parents were on the 1976 Air France flight that was hijacked by the Palestine Liberation Organization. The terrorists forced the airplane to land in Uganda. There, they separated all of the Israeli passengers from the others and threatened them with death. Even though Ms. Neuberger’s parents were not Israeli, they were identifiably religious Jews and that was enough for the terrorists to target them, placing them with the Israeli passengers and threatening their lives. “My parents had American passports,” Ms. Neuberger said, “but because my father wore a kippah they knew he was Jewish and decided to keep him too.”

 

Ms. Neuberger’s parents – and over one hundred other passengers – were rescued in a dramatic raid by Israeli commandos. That horrible experience made a profound impression on Ms. Neuberger. “Threats from those that want to cause us harm are real and not going away,” she’s explained. “A military saved my parents… My life would look very different if not for that military operation. So (I understand) that there are threats where sometimes only a government, only a military, can bring peace.”

 

Throughout her long career, Ms. Neuberger has faced little anti-Jewish sentiment – until now. “If you are professional in your job and comfortable in adhering to your traditions, everyone will be fine with it,” she’s observed. “All my coworkers understand that I don’t go out with them for drinks on Friday night and that I observe the Sabbath. In fact, I have assistants who keep their eye on the clock for me Friday afternoons, letting me know that I had better get moving.”

 

Ms. Neuberger is also optimistic about the future for Orthodox Jewish professional women like herself. “My 17-year-old daughter, who attends an Orthodox school, went to a career night” in her school, Ms. Neuberger has recalled, noting that “religious women in a range of fields – doctors, lawyers, judges – came to speak to them. That would have been unheard of 25 years ago, when I was in high school. And now I want to contribute to that movement and participate in it as much as I can.”
