Parsha Ki Teitzei

 

 

This week, we continue with Moshe’s speech. But only next week near the conclusion we learn where and when is the blessing and the curse mentioned two Parshiyos before.

 

21:10 When thou go forth to battle against thine enemies, and the LORD thy God delivers them into thy hands, and thou carry them away captive, 11 and see among the captives a woman of goodly form, and thou hast a desire unto her, and would take her to thee to wife; 12 then thou shalt bring her home to thy house; and she shall shave her head, and pare her nails; 13 and she shall put the raiment of her captivity from off her, and shall remain in thy house, and bewail her father and her mother a full month; and after that thou mayest go in unto her, and be her husband, and she shall be thy wife. 

 

She will look like GI Jane with her head shaved and in bad clothing. Then and only then can she be your wife. This will give her time to mourn and either like or hate you. If she hates you, then shall she be set free.

 

14 And it shall be, if thou have no delight in her, then thou shalt let her go whither she will; but thou shalt not sell her at all for money, thou shalt not deal with her as a slave, because thou hast humbled her. 

 

If not the first day of the capture then after a month he humbles her.

 

15 If a man have two wives, the one beloved, and the other hated, and they have borne him children, both the beloved and the hated; and if the first-born son be hers that was hated; 

 

The hated wife ‘s son becoming the first born might change her attitude and behavior towards the husband. The most likely thing is that the first wife he married young and then the second wife he chose being older and wiser and not for beauty or the original lure but to be a wife and mother.

 

16 then it shall be, in the day that he causes his sons to inherit that which he has, that he may not make the son of the beloved the first-born before the son of the hated, who is the first-born; 17 but he shall acknowledge the first-born, the son of the hated, by giving him a double portion of all that he hath; for he is the first-fruits of his strength, the right of the first-born is his. 

 

So, this wife’s son has a double portion. Maybe she will be nicer to him and be less hated.

 

18 If a man have a stubborn and rebellious son, that will not hearken to the voice of his father, or the voice of his mother, and though they chasten him, will not hearken unto them; 

 

Ben Sorah v’morah is a rebel against the father or parents and G-D. According to Talmud Sanhedrin it comes from taking a captive woman as this Pasuk is close the earlier Pasuk. The captive hates deep down her husband and raises her son to become a rebel against the father. Chaggit was such a woman and her son Avshalom became a rebel against Dovid, his father. 

 

19 then shall his father and his mother lay hold on him, and bring him out unto the elders of his city, and unto the gate of his place; 20 and they shall say unto the elders of his city: ‘This our son is stubborn and rebellious, he doth not hearken to our voice; he is a glutton, and a drunkard.’ 

 

He has to be between the age of 13 and 13.5 years old. He has to eat a lot of food in fact an abnormal amount and drink alcohol to an extent that he gets drunk. The thought is that if he does this at the young age he will be forced to steal and murder for his existence. Therefore, the Torah puts him to death to save society.

 

21 And all the men of his city shall stone him with stones, that he die; so shalt thou put away the evil from the midst of thee; and all Israel shall hear, and fear. 22 And if a man have committed a sin worthy of death, and he be put to death, and thou hang him on a tree; 

 

The Ben Sorah v’morah is not quite that wicked now but with his stealing and glutton characteristics he will grow into a Mafia type and is killed young to prevent it so that one should fear G-D.

 

23 his body shall not remain all night upon the tree, but thou shalt surely bury him the same day; for he that is hanged is a reproach unto God; that thou defile not thy land which the LORD thy God gives thee for an inheritance. 

 

Man was created in the image of G-D and therefore respect for the human body.

 

22:1 Thou shalt not see thy brother’s ox or his sheep driven away, and hide thyself from them; thou shalt surely bring them back unto thy brother. 

 

You are not allowed to ignore the plight of a fellow Israelite aka Jew. Whether it is his animal, property, jewelry or something else. You should see to it that his property is returned.

 

2 And if thy brother be not nigh unto thee, and thou know him not, then thou shalt bring it home to thy house, and it shall be with thee until thy brother require it, and thou shalt restore it to him. 3 And so shalt thou do with his ass; and so shalt thou do with his garment; and so shalt thou do with every lost thing of thy brother’s, which he hath lost, and thou hast found; thou mayest not hide thyself. 

 

These two Pasukim explain that it pertains to anything even a simple piece of clothing.

 

4 Thou shalt not see thy brother’s ass or his ox fallen down by the way, and hide thyself from them; thou shalt surely help him to lift them up again. 

 

This repeat makes certain that even a Jewish ‘enemy’ is to be helped.

 

5 A woman shall not wear that which pertains unto a man, neither shall a man put on a woman’s garment; for whosoever doeth these things is an abomination unto the LORD thy God. 

 

This is not putting a skirt over one’s pants and a lady’s wig for a Purim Skit but trans-dressing. The Torah forbids homosexual and transsexual behavior in anyway.

 

6 If a bird’s nest chance to be before thee in the way, in any tree or on the ground, with young ones or eggs, and the dam sitting upon the young, or upon the eggs, thou shalt not take the dam with the young; 7 thou shalt in any wise let the dam go, but the young thou mayest take unto thyself; that it may be well with thee, and that thou mayest prolong thy days. 

 

There are two Mitzvos in the Torah that speak about prolonging your days. This and honoring one’s parents. The prolonging your days is in the next world. Acher saw a father tell his son to climb a palm tree and bring down the young birds. He did and fell the height of the Palm Tree to his death. This drove Acher out of his mind and out of Torah Judaism. Had he accepted the prolonging of days in the next world it would have saved him. For this reason, I brought the commentary before his story.

 

8 When thou build a new house, then thou shalt make a parapet for thy roof, that thou bring not blood upon thy house, if any man falls from thence. 

 

As with the accidental murderer who flees to the city of refuge, so too here safety is our main concern.

 

9 Thou shalt not sow thy vineyard with two kinds of seed; lest the fulness of the seed which thou hast sown be forfeited together with the increase of the vineyard.

12 Thou shalt make thee twisted cords upon the four corners of thy covering, wherewith thou cover thyself.

13 If any man take a wife, and go in unto her, and hate her, 14 and lay wanton charges against her, and bring up an evil name upon her, and say: ‘I took this woman, and when I came nigh to her, I found not in her the tokens of virginity’; 15 then shall the father of the damsel, and her mother, take and bring forth the tokens of the damsel’s virginity unto the elders of the city in the gate. 16 And the damsel’s father shall say unto the elders: ‘I gave my daughter unto this man to wife, and he hates her; 17 and, lo, he hath laid wanton charges, saying: I found not in thy daughter the tokens of virginity; and yet these are the tokens of my daughter’s virginity.’ And they shall spread the garment before the elders of the city. 

 

We need a little background here to explain the meaning and death penalty. For if you or I were to go into a woman on the wedding night so we could lower the Ketuvah or get a divorce but no death penalty would be involved today.

 

The explanation is as follows: In ancient times, a man would contract to marry a woman. There were three methods of becoming Engaged. They were by contract, purchasing or acquiring his fiancée with a ring or money and the possibility of full relations. If the person became engaged by the first two ways, then if she was found not be a virgin she could suffer the death penalty for being a married woman. If however, he became betrothed by the last option then the father would stow away the proof of her virginity.

 

Today we don’t do this so in any case she would just be of lesser morals. It was also known that even in ancient times the women in Yehuda vs. the Galil would purposely wound themselves so as not to refrain on the nuptial night for so and so many days until Mikvah or next month. Neither custom exists today and late teens or early 20’s may have had a stretched membrane so that claims are not really popular today.

 

18 And the elders of that city shall take the man and chastise him. 19 And they shall fine him a hundred shekels of silver, and give them unto the father of the damsel, because he hath brought up an evil name upon a virgin of Israel; and she shall be his wife; he may not put her away all his days. 

 

After slandering her, you can imagine how much of a loving wife he will have all the days of his life.

 

20 But if this thing be true, that the tokens of virginity were not found in the damsel; 21 then they shall bring out the damsel to the door of her father’s house, and the men of her city shall stone her with stones that she die; because she hath wrought a wanton deed in Israel, to play the harlot in her father’s house; so shalt thou put away the evil from the midst of thee. 

 

This was clear that she had been bound to the man by full engagement as mentioned above. However, in our corrupt times it is hard to find what was once common place in Israel especially so among the non-religious. [In my generation, after WWII many women were more moral but a few years younger than I the Hippie Free Love Culture took over and destroyed them.]

 

22 If a man be found lying with a woman married to a husband, then they shall both of them die, the man that lay with the woman, and the woman; so shalt thou put away the evil from Israel. 

 

This is to stop evil in Yisrael and Maumzerim.

 

23 If there be a damsel that is a virgin betrothed unto a man, and a man find her in the city, and lie with her; 24 then ye shall bring them both out unto the gate of that city, and ye shall stone them with stones that they die: the damsel, because she cried not, being in the city; and the man, because he hath humbled his neighbor’s wife; so thou shalt put away the evil from the midst of thee. 

 

This would apply to a city where people would interact and come to her help. It does not apply to places like the south side of Chicago, Harlem NY, South Beach Miami, many sections of Portland OR, LA, SF and others around the world where the damsel would be a victim. It is evil.

 

25 But if the man finds the damsel that is betrothed in the field, and the man take hold of her, and lie with her; then the man only that lay with her shall die. 26 But unto the damsel thou shalt do nothing; there is in the damsel no sin worthy of death; for as when a man rises against his neighbor, and slays him, even so is this matter. 

 

From here we learn not only is the damsel innocent but rape is like murder for a woman.

 

27 For he found her in the field; the betrothed damsel cried, and there was none to save her. 

 

She could scream at the top of her lungs and nobody would be in ear shot.

 

28 If a man find a damsel that is a virgin, that is not betrothed, and lay hold on her, and lie with her, and they be found; 29 then the man that lay with her shall give unto the damsel’s father fifty shekels of silver, and she shall be his wife, because he hath humbled her; he may not put her away all his days.

 

He can never put her away if he raped her and she can nag him all his days. However, a person who persuaded a woman similar to mutual consent in a marriage can divorce her.

It is however frowned upon in no uncertain terms. However, there is no guardian to passion between a man and a woman.

 

23:1 A man shall not take his father’s wife, and shall not uncover his father’s skirt. 

 

Obviously, this is a second wife that his father has taken. (It could be he was a widower, divorced or polygamy.)

 

2 He that is crushed or maimed in his privy parts shall not enter into the assembly of the LORD. 3 A bastard shall not enter into the assembly of the LORD; even to the tenth generation shall none of his enter into the assembly of the LORD. 4 An Ammonite or a Moabite shall not enter into the assembly of the LORD; even to the tenth generation shall none of them enter into the assembly of the LORD forever; 5 because they met you not with bread and with water in the way, when ye came forth out of Egypt; and because they hired against thee Balaam the son of Beor from Pethor of Aram-naharaim, to curse thee. 6 Nevertheless the LORD thy God would not hearken unto Balaam; but the LORD thy God turned the curse into a blessing unto thee, because the LORD thy God loved thee. 7 Thou shalt not seek their peace nor their prosperity all thy days for ever. 

 

The first two cases are from Yisrael and the later cases of non-Jews. However, the ruling is that the women of Moav and Ammon can marry it was the males that were vicious.

 

8 Thou shalt not abhor an Edomite, for he is thy brother; thou shalt not abhor an Egyptian, because thou were a stranger in his land. 9 The children of the third generation that are born unto them may enter into the assembly of the LORD. 

 

We do accept converts from them.

 

10 When thou go forth in camp against thine enemies, then thou shalt keep thee from every evil thing. 11 If there be among you any man, that is not clean by reason of that which chances him by night, then shall he go abroad out of the camp, he shall not come within the camp. 12 But it shall be, when evening cometh on, he shall bathe himself in water; and when the sun is down, he may come within the camp. 13 Thou shalt have a place also without the camp, whither thou shalt go forth abroad. 

 

Soldiers were expected to be ritually and spiritually pure so as to win battles. G-D in his great mercy today is allowing his people to return to Eretz Yisrael and I have done border patrol along with unreligious Kibbutzniks who had no knowledge of Tahor or Tumay. But back then and perhaps in the future it was/could be imperative.

 

14 And thou shalt have a paddle among thy weapons; and it shall be, when thou sit down abroad, thou shalt dig therewith, and shalt turn back and cover that which cometh from thee. 

 

During basic training, we all had shovels in our kit bag or back pack but I never received one for the next 19 plus years of my service.

 

15 For the LORD thy God walks in the midst of thy camp, to deliver thee, and to give up thine enemies before thee; therefore, shall thy camp be holy; that He see no unseemly thing in thee, and turn away from thee. 

 

The reason why your war camp should be clean physically and Tahor is that G-D walks in your midst. That explains a lot of miracles and less wounded and casualties among Yisrael.

 

16 Thou shalt not deliver unto his master a bondman that is escaped from his master unto thee; 17 he shall dwell with thee, in the midst of thee, in the place which he shall choose within one of thy gates, where it likes him best; thou shalt not wrong him. 

 

Assuming that he is not a complete cheat, he has been treated poorly or beaten or berated often, he has no reason to run away from his master, food, board clothing, maybe a woman and severance pay.

 

18 There shall be no harlot of the daughters of Israel, neither shall there be a sodomite of the sons of Israel. 

 

I am not one who is over sensitive, but in a certain orchard by the road on highway four I used to see a lot of young girls/women of high school or college age and thought it was an agriculture school there. The Tel Aviv to Ashdod bus used to go there as highway two was not built yet.

 

One day I saw a car with Gaza Plates stop there. A man handed one of the girls money and she started walking behind a tree picking up her skirt in the process. I was a new immigrant to Israel and was used to Jewish Girls in New York of being from good families and even the Reform in my generation were virgins in College. I had not been the sensitive type. I did not cry when my hero JFK was assassinated. But when I saw this my eyes began streaming that such a thing could happen to a Jewish girl.       

 

19 Thou shalt not bring the hire of a harlot, or the price of a dog, into the house of the LORD thy God for any vow; for even both these are an abomination unto the LORD thy God. 

 

The way of earning the money like being a prostitute or running a puppy mill is not a profession(s) looked favorably by G-D. Therefore, keep the money for yourself and earn an honorable wage.

 

20 Thou shalt not lend upon interest to thy brother: interest of money, interest of victuals, interest of anything that is lent upon interest. 

 

The question arises is with the banks. Can I receive money by lending to these business institutions? I gave them money and let us say receive 3% interest. They are getting from me half a percent under the 3.5% prime rate that they have to pay the government. Instead they lend out at 5% or more and make 2% off of my Shekels from another Jew.

 

21 Unto a foreigner thou mayest lend upon interest; but unto thy brother thou shalt not lend upon interest; that the LORD thy God may bless thee in all that thou put thy hand unto, in the land whither thou go in to possess it. 

 

The non-Jew may be your fellow man but the Torah does not view him as a brother. Even more so, if a Ger Tzedek has a biological brother who did not convert, if he wants he can lend to him on interest.

 

22 When thou shalt vow a vow unto the LORD thy God, thou shalt not be slack to pay it; for the LORD thy God will surely require it of thee; and it will be sin in thee. 23 But if thou shalt forbear to vow, it shall be no sin in thee. 

 

Don’t be a slacker! Especially with Tzeduka payments.

 

24 That which is gone out of thy lips thou shalt observe and do; according as thou hast vowed freely unto the LORD thy God, even that which thou hast promised with thy mouth. 25 When thou come into thy neighbor’s vineyard, then thou mayest eat grapes until thou have enough at thine own pleasure; but thou shalt not put any in thy vessel. 

 

I am assuming the Peah or corner of the field left for the poor. One can eat from it

 

26 When thou come into thy neighbor’s standing corn, then thou mayest pluck ears with thy hand; but thou shalt not move a sickle unto thy neighbor’s standing corn.

24:1 When a man taketh a wife, and marries her, then it cometh to pass, if she find no favor in his eyes, because he hath found some unseemly thing in her, that he writes her a bill of divorcement, and gives it in her hand, and sends her out of his house, 

 

According to Rabbaynu Gershom, both have to agree to a divorce. If the woman becomes unbearable, lazy, develops a smell or smells, abuses the children or endangers them. It becomes imperative to divorce her also a husband who abuses and other troublesome qualities this could be drinking, drugs, child abuse and more. Just as it is a Mitzvah to marry and try for Shalom Beis, sometimes it is a Mitzvah to Divorce.

 

2 and she departs out of his house, and goes and becomes another man’s wife, 3 and the latter husband hates her, and writes her a bill of divorcement, and gives it in her hand, and sends her out of his house; or if the latter husband die, who took her to be his wife; 

 

Eric Sinai and his wife divorced for whatever reason. She went on to marry a man worth $700 to $1000 million dollars. The man was 20 some odd years her senior and in his mid to late nineties passed away. She could never marry Eric. This way, the Torah tells us not to be disgusting.

 

4 her former husband, who sent her away, may not take her again to be his wife, after that she is defiled; for that is abomination before the LORD; and thou shalt not cause the land to sin, which the LORD thy God gives thee for an inheritance. 

 

Not only has Eretz Yisrael the propensity to vomit out the wicked. But in Vayikra 19:1 we were told to be Holy for I, the L-RD, your G-D am Holy.

 

5 When a man taketh a new wife, he shall not go out in the host, neither shall he be charged with any business; he shall be free for his house one year, and shall cheer his wife whom he hath taken. 6 No man shall take the mill or the upper millstone to pledge; for he taketh a man’s life to pledge. 

 

In the Shulchan Aruch Choshen Mishpat around Siman Ayin to Ayin Dalet or Ketuvos Dafim 84B – 85 AB, there are laws and discussion about seizing and forbidden to seize property of a person who owes us money or the pledge that we gave somebody who passed away and we owe him money. In any event, we cannot take a man or a woman’s last piece of clothing or their tools of their trade for a pledge.

 

7 If a man be found stealing any of his brethren of the children of Israel, and he deal with him as a slave, and sell him; then that thief shall die; so shalt thou put away the evil from the midst of thee. 

 

 

 

8 Take heed in the plague of leprosy, that thou observe diligently, and do according to all that the priests the Levites shall teach you, as I commanded them, so ye shall observe to do. 9 Remember what the LORD thy God did unto Miriam, by the way as ye came forth out of Egypt. 

 

Like some of the other Mitzvos above, this is a recap reminder for us.

 

10 When thou dost lend thy Neighbor any manner of loan, thou shalt not go into his house to fetch his pledge. 11 Thou shalt stand without, and the man to whom thou dost lend shall bring forth the pledge without unto thee. 12 And if he be a poor man, thou shalt not sleep with his pledge; 13 thou shalt surely restore to him the pledge when the sun goes down, that he may sleep in his garment, and bless thee; and it shall be righteousness unto thee before the LORD thy God. 

 

Panosa (income) comes from HASHEM. People have won the lottery and became worse off. Mike Tyson made hundreds of millions in boxing and blew it on expensive cars and big parties for his friends. Arnold Schwarzenegger invested in Planet Hollywood, stocks and other ventures and from tens of millions into $450,000,000 estimated per search engine.  

 

14 Thou shalt not oppress a hired servant that is poor and needy, whether he be of thy brethren, or of thy strangers that are in thy land within thy gates. 15 In the same day thou shalt give him his hire, neither shall the sun go down upon it; for he is poor, and sets his heart upon it: lest he cry against thee unto the LORD and it be sin in thee. 

 

Two very wealthy people are beloved by their workers. The Queen of England who just passed and Donald J. Trump. They gave their servants or workers decent pay, praise and trust and if the person was no good, they deserved to be let go. So the Torah requires us to pay the daily worker on a day to day basis.

 

16 The fathers shall not be put to death for the children, neither shall the children be put to death for the fathers; every man shall be put to death for his own sin. 

 

We are accountable for trying to prevent sin but not accountable for the sin itself.

 

17 Thou shalt not pervert the justice due to the stranger, or to the fatherless; nor take the widow’s raiment to pledge. 18 But thou shalt remember that thou were a bondman in Egypt, and the LORD thy God redeemed thee thence; therefore, I command thee to do this thing. 

 

Remember the orphan and widow for their tears and complaints are listened to. Even the stranger as you were strangers and ignored.

 

19 When thou reap thy harvest in thy field, and hast forgot a sheaf in the field, thou shalt not go back to fetch it; it shall be for the stranger, for the fatherless, and for the widow; that the LORD thy God may bless thee in all the work of thy hands. 

 

This is the forgotten sheath that Ruth was gathering for Naomi so that they starved not.

 

20 When thou beat thine olive-tree, thou shalt not go over the boughs again; it shall be for the stranger, for the fatherless, and for the widow. 21 When thou gather the grapes of thy vineyard, thou shalt not glean it after thee; it shall be for the stranger, for the fatherless, and for the widow. 22 And thou shalt remember that thou were a bondman in the land of Egypt; therefore, I command thee to do this thing. 

 

What is among the stalks of produce or vegetables also applies to fruits.

 

25:1 If there be a controversy between men, and they come unto judgment, and the judges judge them, by justifying the righteous, and condemning the wicked, 2 then it shall be, if the wicked man deserve to be beaten, that the judge shall cause him to lie down, and to be beaten before his face, according to the measure of his wickedness, by number. 3 Forty stripes he may give him, he shall not exceed; lest, if he should exceed, and beat him above these with many stripes, then thy brother should be dishonored before thine eyes. 

 

If a doctor determines that he cannot take any more punishment then he is left alone and if he soils his pants that is a sign that he is fainting or about to die and his penalty was not the death penalty but stripes so we stop.

 

4 Thou shalt not muzzle the ox when he treads out the corn. 

 

 

 

5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband’s brother shall go in unto her, and take her to him to wife, and perform the duty of a husband’s brother unto her. 6 And it shall be, that the first-born that she bears shall succeed in the name of his brother that is dead, that his name be not blotted out of Israel. 7 And if the man like not to take his brother’s wife, then his brother’s wife shall go up to the gate unto the elders, and say: ‘My husband’s brother refuses to raise up unto his brother a name in Israel; he will not perform the duty of a husband’s brother unto me.’ 8 Then the elders of his city shall call him, and speak unto him; and if he stand, and say: ‘I like not to take her’; 9 then shall his brother’s wife draw nigh unto him in the presence of the elders, and loose his shoe from off his foot, and spit in his face; and she shall answer and say: ‘So shall it be done unto the man that doth not build up his brother’s house.’ 10 And his name shall be called in Israel the house of him that had his shoe loosed. {S} 11 When men strive together one with another, and the wife of the one draweth near to deliver her husband out of the hand of him that smiteth him, and putteth forth her hand, and taketh him by the secrets; 12 then thou shalt cut off her hand, thine eye shall have no pity. {S} 13 Thou shalt not have in thy bag diverse weights, a great and a small. 14 Thou shalt not have in thy house diverse measures, a great and a small. 15 A perfect and just weight shalt thou have; a perfect and just measure shalt thou have; that thy days may be long upon the land which the LORD thy God giveth thee. 16 For all that do such things, even all that do unrighteously, are an abomination unto the LORD thy God. {P}

17 Remember what Amalek did unto thee by the way as ye came forth out of Egypt; 18 how he met thee by the way, and smote the hindmost of thee, all that were enfeebled in thy rear, when thou were faint and weary; and he feared not God. 19 Therefore it shall be, when the LORD thy God hath given thee rest from all thine enemies round about, in the land which the LORD thy God giveth thee for an inheritance to possess it, that thou shalt blot out the remembrance of Amalek from under heaven; thou shalt not forget. 

 

The fight against G-D and Am Yisrael is built into the nature of Amalek.

 

 

Elul preparing for Judgement Day by Rabbi Rachamim Pauli

 

My long-term readers know me as a man who puts in an attempt to guard his health. I work out in the gym listening to Gemara aka Daf Yomi as I do aerobics or work out without my personal trainer on weights. I don’t try to over-do it as I am 75years of age. I do try to be active. Despite my morbid obesity that crept up on me every time I had a health crisis or the kilograms gained during the lockdown I felt reasonable fit.

 

Last year, I put up with internal bleeding that caused my hemoglobin to go down to seven. I was operated upon and after a rest returned to sports. Lately, I was feeling down and during the heat could not do my weight lifting. With the exception of the leg muscles relatively light weights from my early 60’s.

 

My friend from work, Meir, a ex-military paramedic, suggested that I take my blood pressure. The BP was like that of a young man but the heart beat was 40. I played around with the dosage of my Cardoloc (heart medication) for my arterial fibrillations. I got the pulse up to 60-64. The Cardiologist gave me half the dosage and the pulse is 53 or more.

 

You might ask what does all this have to do with Elul. He sent me for a test with radioactive material in the veins to view the heart. The results were not good.

 

Maybe it is a case similar to Shimshon’s riddle – from the bold came out sweetness. If there is an easy cure.

 

What does this have to do with Elul? I was living a simple and happy life each week the gym, Daf Yomi, writing the Blogspot and learning Shulchan Aruch with Rabbi Mimran Shlita. We have completed close to between 3/5ths to 2/3rds of the Shulchan Aruch by learning here and there from half an hour to 40minutes on the phone close to 5times a week.

 

Slowly but surely a Daf or Mishnayos Yomi finishes Shas and a few Halachos a day finishes Shulchan Aruch. If with my lousy Hebrew Reading ability of a working man who started learning Hebrew in his 20’s can do it all the more so a person who learned Hebrew Reading as a child.

 

What about Teshuva, Tephillah V’ Tzedakah (repentance, prayer and charity) to avoid the evil decree. Everybody and his Torah Strength. Some say Psalms, some pledge more charity and some review their deeds daily and do Teshuva.

 

Think for yourself what you can do for Am Yisrael to balance the scales. Can you learn? Repent? Pray? Or organize a Charity or other Chesed like visiting the sick, feeding or clothing the poor with good used clothing or helping out burying the dead or comforting mourners.

 

Repent now for one never knows what can hit him.

How would you feel if you discovered that your Rabbi – a person you respect as a wise, kindhearted scholar – was also struggling with addiction? Would his struggle make you think less of him, or even disqualify him as your spiritual guide?

 

This question is no mere theoretical discussion for a university ethics classroom; it’s a real-life dilemma that first came to light over 350 years ago in the Jewish ghetto of Venice.

 

Rabbi Leon (Judah) Modena (1571-1648), one of Italy’s greatest rabbinic scholars, began writing his autobiography two months after the death of his eldest son, Mordecai, in 1617. The Life of Judah (Chayei Yehuda), one of the earliest and most important autobiographies in Jewish history, offers a fascinating glimpse into the life of a struggling Jewish family in 17th century Italy.

 

At the same time, and with surprising frankness, Rabbi Modena admits to a lifelong struggle with gambling – an addiction which threatened his family’s financial stability in his own lifetime and has damaged his reputation ever since his passing.

 

With painful honesty, Rabbi Modena describes his difficult relationship with his three sons, each of whom caused him great grief. “One died,” poisoned by his experiments with alchemy, “one was murdered” by members of his Jewish gang, “and one lives in exile,” encouraged to leave the family home due to his delinquent lifestyle. His relationship with his wife was equally complicated; the sister of his intended bride, he was forced to marry her after his fiancée became ill and passed away. In later life, his wife was first sickly and later mentally ill, a situation which nearly put him over the edge even as his own health began to fail. All of these personal struggles occurred against a backdrop of instability for the entire Jewish community, which was nearly expelled from Venice in 1637.

 

Despite all of his travails, Rabbi Modena became one of the great Torah scholars of his time, mastering a wide array of disciplines, from the Talmud and Jewish philosophy to Latin grammar and Italian poetry. Recognized as a prodigy from a young age, he grew up to become a celebrated educator and orator whose reputation spread beyond the walls of the ghetto, so much so that Catholic friars and foreign notables often came to Venice’s Great Synagogue to hear him speak.

 

At the same time, Rabbi Modena authored several important works of scholarship on Jewish-Christian polemics, the history of Kabbalah and Jewish ethics. Jarringly, he includes a list of his writings immediately following his frightening description of his son Zebulon’s murder, which took place before his eyes. His books were “a source of great comfort,” a legacy in place of his sons that would ensure his “name will never be blotted out among the Jews or in the world at large."

 

Throughout the memoir, Rabbi Modena refers often to his “sins,” but writes openly about only one in particular: gambling. He began playing games of chance on Hanukkah when he was 23, playing off and on for the rest of his long life. By his own admission, he almost always lost, gambling away his daughters’ dowries and going heavily into debt.

 

Gambling, in all its forms, has been frowned upon by rabbinic authorities throughout the ages. In the Talmud, gambling is viewed as a form of theft, since the person who loses the game never really makes peace with his losses. Though not formally forbidden by Jewish law, the professional gambler is disqualified from serving as a witness in a Jewish court, for gamblers “do nothing to promote the benefit of society.”

 

As anyone struggling with addiction can relate to, Rabbi Modena experienced ups and downs in his fight to overcome his addiction. “During Hanukkah [December 23-20, 1598], “Satan” duped me into playing games of chance, and by the following Shavuot [May 30-31, 1599], I lost more than 300 ducats. But from then until the eve of Hanukkah [November 30, 1600], I watched myself carefully, devoting myself to my teaching for 18 months, and paid all my debts.”

 

Though he was able to control himself for long stretches of time, his addiction always threatened to drag him back to the card table. “In the month of Heshvan 5369 [September-October 1608], I moved into the Ghetto Nuovo… There I had many pupils throughout the winter. But I did what the angel messengers said to Sarah in answer to her denial [namely, played games of chance] until my behavior became so wild that I agreed to go live away from Venice. Through correspondence I contracted to go to Florence, to preach and to teach students for an annual salary of 220 ducats, paid by the community.” His gambling problem threatened, but fortunately never ruined his career.

 

Troubled by his conscience, Rabbi Modena offers excuses for his repeated lapses. His gambling episodes almost always followed some personal or professional calamity. After the death of his favorite son Mordechai, he writes “I returned out of great anxiety to the enemy . . . playing at games of chance.” Given Rabbi Modena’s tragic family life, its hard not sympathize with him. In the wake of tragedy, it’s only natural to seek some form of diversion, however transient.

 

Ultimately, however, Rabbi Modena himself was not satisfied with these excuses. He considered gambling to be his primary sin, “the sin of Judah,” and was troubled throughout his life by the incongruity of his rabbinic role and gambling addiction.

 

A fairytale ending seems to have eluded Rabbi Leon Modena. To the very end of his life, he struggled, with only partial success, to control his desire to gamble. His inability to achieve a clear-cut victory over his temptations – commonly present in Christian autobiographies of his time – significantly damaged his reputation in many circles.

 

Controlling our passions and temptations is not a zero-sum game. It is possible, even within our failures, to serve God with great authenticity.

 

But declaring Rabbi Modena a failure strikes me as simplistic and misguided. All recovering addicts understand that addictions are rarely “conquered” once and for all. The danger of a relapse is always present; battling an addiction is a long-term process that rarely comes with a definitive or perfect ending.

 

Delving deeper, Jewish thinkers have long recognized that controlling our passions and temptations is not a zero-sum game. It is possible, even within our failures, to serve God with great authenticity. As Rabbi Tzvi Meir Zilberberg, a prominent Hassidic Rabbi in Jerusalem with a diverse following, argues powerfully, “Every effort, every attempt, every desire, every yearning and every prayer [to God to overcome one’s temptations] brings great pleasure to the One above. In particular, when we do not succeed in overcoming the animal within us, and yet continue to struggle and do our best to overcome our inclinations - this brings the greatest possible joy to God… and is more precious to God than those moments in which we do succeed in controlling our temptations” (Sichos HischazkusSimchas Beis HaShoeva 5760).

 

During this month of Elul, the Hebrew month leading up to Rosh Hashanah, Jews traditionally begin the process of repentance and return to God which ultimately culminates on Yom KippurWhat does this “process of repentance” consist of? Maimonides identifies three critical steps: regret, confession before God and ultimately abandoning one’s sin. Tellingly, the first two steps – the beginning of real change – consist of honesty; honesty with oneself, and honesty before God. Rejecting excuses and justifications is the first step to real and lasting change.

 

Rabbi Leon Modena never fully overcame his gambling addiction, but as his remarkably honest autobiography makes clear, he heroically refused to give up, continuing his struggle until the day he died. Despite Rabbi Modena’s shortcomings, he taught us that true greatness comes not with success, but through our tireless efforts to achieve them.

Captain Artur Carlos de Barros Basto is known for having been unjustly slandered and dismissed from his military post. Not unlike Alfred Dreyfus, a French artillery officer of Jewish ancestry whose conviction in 1894 on charges of treason became one of the most polarizing political dramas in modern French history.

 

These two men, important military men and decorated heroes, became the target of European antisemitism, which was to become more pronounced in the middle of the 20th century, with the start of World War II.

 

The military officer is an unknown figure outside Portugal, unlike Dreyfus, but his story is equally or more interesting. Barros Basto dedicated himself to Jewish writing and even more important was his work as a community leader. In addition, he made a great contribution to the struggle of Conversos - Sephardic Jews who were once forced to convert to Catholicism. In fact, Captain Barros Basto was one of them.

 

In Portugal, a very special historical phenomenon occurred, because the concentration of Sephardim was so high that to this day, the Portuguese are largely descendants of those "marranos" - converted Jews - who had little choice in 1497, when they were forced to convert or, leave their land. As in Spain, the Jews faced a great dilemma: whether to leave with all that this entailed or to adopt the new faith.

 

A good number of Jews decided to remain in their homeland, so they had to be baptized and change their names. Some became the most assiduous Christians, mixed with the nobility, with the "old Christians" and even became important members of the Catholic clergy. However, others, in spite of having converted, maintained their Jewish identity while creating themselves a new one, which allowed them to pass unnoticed among their new co-religionists - whether they were new or old Christians.

 

Barros Basto's family had maintained its Hebrew roots throughout the centuries and was clear about it. So, his grandfather, before he died, revealed to him the truth about his past Sephardic origin and that he wished to die as a Jew.

 

There were traditions; like the Shabbat candles, with which the young Artur Carlos had been connected since he was a child. But, they were part of his memory, as well as the memory of his ancestors. Until one day, while in Flanders, Belgium, he entered the tent of a French officer on Saturday, saw two candles illuminating the place, and asked him what was the reason for this particular ceremony. The answer was obvious. And, so decisive was it that he wanted to return to the old faith of his ancestors.

 

Barros Basto, who was born in Amarante in 1887 as a Catholic, decided to embark on the path to a new faith; the same one that centuries ago so many people were forced to abandon, including his predecessors. The Mosaic law, which had also been maintained, in one way or another, among children of those forced to convert - would become the captain's life goal, accompanied by an interest in making others return to their Hebrew origins.

 

Portugal's national archive in the "Torre do Tombo" has more than 40,000 files of the Inquisition, which was tasked with persecuting the "new Christians" accused of secretly living as Jews over the centuries. Although King Manuel I of Portugal promised the converts they would not be investigated for their religious practices in the private sphere, encouraged them to maintain the rituals and traditions of their old religion, which survived the passage of time in many cases.

 

The process of conversion to Judaism of Captain Barros Basto - who was also a Freemason - began in Porto and Lisbon at Shaarei Tikvah Synagogue, but without success. Morocco would then be his place of conversion and return to Judaism.

 

In the city of Tangier, a formal conversion would take place. After returning to Lisbon, he married a Jewish woman from that community, who had not accepted him before. Thus, Lea Israel Montero Azancot became Leah Barros. And, from that moment on, she would begin the campaign of rediscovery and rapprochement of the crypto-Jews.

 

Barros Basto had felt Jewish even before he converted in 1920; however, he encountered difficulties along the way, and even came close to going as far as Algeria in order to proceed with his conversion. He must have thought of all the others who, like him, would eventually want to return to the faith of their parents.

 

In Porto, where there were no more than 20 Jews, Captain Barros Basto or Abraham Israel Ben Rosh - his Hebrew name - founded a newspaper, which he called "Halapid" - The Torch - and began to travel to the neighboring villages where Conversos were to be found. In order to found a new community with these people and to build a synagogue that would later be called: Mekor Haim - a source of life.

 

Barros Basto had learned Hebrew before his conversion, and to such an extent that he later taught the language of his ancestors at the University of Porto. He was also interested in Portuguese medieval Jewish history, among other subjects. Throughout his life, he wrote numerous works on Jewish themes.

 

Barros Basto's initial plan and ideal was to capture the attention of the Conversos and attract them to his communal-religious project. In fact, very early on he began to collect the necessary funds for the construction of a synagogue. The project was so ambitious and structured that, together with other members of his community, they established a yeshiva, in order to teach the Conversos the precepts of the Law of Moses and the history of the Hebrew people. That yeshiva operated for nine years.

 

In Alto Trás-os-Montes - behind the mountains - located in the north of Portugal, bordering Spain and the important Douro River, the Conversos were found in rural villages. Chaves, Bragança and Mirandela are some of the towns that the Trás-os-Montes sub-region included. Captain Barros Basto travelled through this territory in search of his hidden, lost brothers, once forced to encircle themselves in very small and closed communities.

 

The political situation in Portugal had changed when a military coup d'état took place in 1926, giving the Catholic Church a very important position in the society once again. It would not be in their interests for the "marranos" to return to Judaism. Likewise, the fascist Oliveira Salazar dictatorship took power around 1932. Imposing the Catholic tradition and the conservatism of its customs as a regime, similar to the Spanish case with Generalissimo Franco.

 

All the efforts of Captain Artur Carlos hit a major stumbling block when an anonymous letter warned his superiors of immoral behavior on his part. Accused of homosexuality and of perverting the youth of the yeshiva, a trial was opened against him.

 

This slander did not succeed, but it did bring to light that the captain had himself circumcised - brit milah - together with a doctor, his yeshiva pupils. As a result, 9,000 crypto-Jews had turned to Judaism, thanks to him.

 

In 1937, he was expelled from the army, as he was deemed morally unfit to continue in the institution. He could not be accused of being a homosexual, but he could be accused of being a Judaiser, since the Inquisition, which had scourged the entire Iberian Peninsula in an atrocious manner, had undoubtedly left an anti-Jewish remnant.

 

Like Dreyfus, his Jewishness weighed heavily when it came to signing his dismissal. However, Dreyfus was defended by Émile Édouard Charles Antoine Zola, a prominent French writer, in his article J'Accuse - Letter to the President of the Republic - in the newspaper L'Aurore.

 

This plea, in the form of an open letter, was the key to the reinstatement of Captain Dreyfus' position, name and honor. In the case of Captain Barros Basto, there was never a review of the case during his lifetime and he died with the dishonor brought upon him by the enemies of Judaism.

 

Despite the setback, Captain Barros Basto managed by 1938 to inaugurate the synagogue that had become his dream. Mekor Haim or the Kadoorie Synagogue (the largest in the entire Iberian Peninsula), in honor of its main sponsors, a prominent Iraqi Jewish family established in Shanghai, China. These Mizrahim Jews decided to erect the building in honor of their matriarch - Laura Kadoorie - who descended from those Jews expelled from Portugal in 1497.

 

This synagogue was not able to concentrate the community of Conversos that Barros Basto had hoped for. The scandal and finally his removal from office also meant that his students and those families in general that he had slowly attracted to Judaism were afraid and, in the end, did not want to be affiliated with Mekor Haim.

 

From the beginning, the Inquisition created a phenomenon of separatism and distrust on the part of these people. Having been forced to convert and not only that, having been persecuted, judged and even killed, was a good enough reason to turn away from that world.

 

However, the synagogue served great purpose after World War II, becoming a shelter for hundreds of Jews from Eastern Europe who were escaping the horror of the Nazi regime. Barros Basto, therefor, could also be considered a "righteous among the nations".

 

The Synagogue of Oporto is the most important work of Captain Barros Basto. It represents the freedom, the constant struggle and the great affection that its founder had, together with the Ashkenazi families of the community of Oporto who supported their leader in this noble project.

 

Captain Barros Basto died in Oporto in 1961, taking to his grave the injustice of being accused of a "crime" called being Jewish. He was the leader of his community until the end. Unlike Dreyfus, in one way or another, Barros Basto died of moral grief.

 

He was never reinstated in the army, nor was his case reviewed. Until 2012, the Portuguese state posthumously reinstated Barros Basto as a captain, thanks to the efforts of his granddaughter Isabel Ferreira Lopes. So, let the memory of Barros Basto be live on.
