Parsha Emor
Last week with about 55
Mitzvos, I had to skip a lot. Even this week is a Parsha rich in Mitzvos. Last
week started out with the holiness of the ordinary Ben Yisrael or even Levi.
This week we are starting out with the holiness of a Cohain and who he may or
may not marry.
21:1 And the
LORD said unto Moses: Speak unto the priests the sons of Aaron, and say unto
them: There shall none defile himself for the dead among his people;
An ordinary Ben Yisrael or Levi (like Aaron’s cousins who
buried his sons) can deal with purification and burial of the dead. A Cohain is
one who enters into the Mikdash and offers up sacrifices before G-D.
2 except for his kin, that is near unto him, for his
mother, and for his father, and for his son, and for his daughter, and for his
brother; 3 and for his sister a virgin, that is near unto him, that
hath had no husband, for her may he defile himself.
A Cohain can take care of burying any one of seven relatives
but usually somebody else close to the family takes care of this. Somebody like
a son-in-law, brother-in-law etc. deals with the burial.
4 He shall not defile himself, being a chief man among
his people, to profane himself. 5 They shall not make baldness upon
their head, neither shall they shave off the corners of their beard, nor make
any cuttings in their flesh.
I assume that the baldness is like that of a medieval Friar.
Even an ordinary Jew should not shave the corners of their beards and the
cuttings of the flesh is something done among the Shiites in Lebanon.
6 They shall be holy unto their God, and not profane the
name of their God; for the offerings of the LORD made by fire, the bread of
their God, they do offer; therefore they shall be holy.
Returning to my first thought above, the Cohain is special as
he does the Korbanos.
7 They shall not take a woman that is a harlot, or
profaned; neither shall they take a woman put away from her husband; for he is
holy unto his God.
The Cohain’s wife cannot be a woman of loose morals. She
cannot be a Jew who tried all sorts of cults and even repented. She cannot be
divorced as that is a blemish. Just as he who serves cannot be with certain
blemishes so too must the wife of a Cohain who will issue his children.
8 Thou shalt sanctify him therefore; for he offers the
bread of thy God; he shall be holy unto thee; for I the LORD, who sanctify you,
am holy. 9 And the daughter of any priest, if she profane herself by
playing the harlot, she profanes her father: she shall be burnt with
fire.
Only if she is married and committed adultery or harlotry
then she is put to death by the Sanhedrin by ‘burning’ that consists of pouring
molten lead into her (See Meseches Sanhedrin).
10 And the priest that is highest among his brethren,
upon whose head the anointing oil is poured, and that is consecrated to put on
the garments, shall not let the hair of his head go loose, nor rend his
clothes;
He must wear impeccable clothing. The haircut of the Cohain
Gadol had one follicle of hair touching the root of the next follicle. Every
Cohain had to have short hair.
11 neither shall he go in to any dead body, nor defile
himself for his father, or for his mother;
The Cohain HaGadol cannot defile himself with burying his own
parents or wife.
12 neither shall he go out of the sanctuary, nor profane
the sanctuary of his God; for the consecration of the anointing oil of his God
is upon him: I am the LORD.
While an ordinary Cohain can visit pure places without
defiling himself, the Torah wants him to be only in the Mishkan/Mikdash area.
13 And he shall take a wife in her virginity.
Only the Cohain HaGadol is required to marry a virgin.
Another Cohain can do Levirate Marriage.
14 A widow, or one divorced, or a profaned woman, or a
harlot, these shall he not take; but a virgin of his own people shall he take
to wife.
An ordinary Cohain can marry his brother’s widow. Or even any
widow but a divorced woman or one of ill repute no.
15 And he shall not profane his seed among his people;
for I am the LORD who sanctify him.
A few chapters of Halacha in Eben HaEzer at the beginning of
the Sefer into looking into a proper wife for a Cohain. It deals with family
roots of a potential spouse as well as the woman, herself. The same applies
even to an ordinary Jew on a lesser in strictness level. Obviously, one does
not want a son or daughter marrying into a Mafia Family or that of low morals
or a cult. On the other hand, some people are true Baalei Teshuva and have
returned from Guru or other Cults. I, myself, came from a sixth generation
Reform Family on my mother’s side but we were outstanding citizens and just
born non-religious. But when it came to a Shiduch I was considered third class
as I had not learned in a Jewish School and in the beginning I had not traced
my roots to great-Rabbis or Kings. This is not to be laughed at but in reality,
it is the individual who will became what he/she will become.
16 And the LORD spoke unto Moses,
saying: 17 Speak unto Aaron, saying: Whosoever he be of thy seed
throughout their generations that hath a blemish, let him not approach to offer
the bread of his God. 18 For whatsoever man he be that hath a
blemish, he shall not approach: a blind man, or a lame, or he that hath
anything maimed, or anything too long, 19 or a man that is
broken-footed, or broken-handed, 20 or crook-backed, or a dwarf, or
that hath his eye overspread, or is scabbed, or scurvy, or hath his stones
crushed; 21 no man of the seed of Aaron the priest, that hath a
blemish, shall come nigh to offer the offerings of the LORD made by fire; he
hath a blemish; he shall not come nigh to offer the bread of his God.
All these physical defects make it forbidden for him to serve
in the performance of the rites associated with a Koran.
22 He may eat the bread of his God, both of the most
holy, and of the holy. 23 Only he shall not go in unto the veil, nor
come nigh unto the altar, because he hath a blemish; that he profane not My
holy places; for I am the LORD who sanctify them.
He can flay the Korban and other activities but not the act
of officiating in the Sacrifice.
24 So Moses spoke unto Aaron, and to his sons, and unto
all the children of Israel. 22:1 And the LORD spoke unto
Moses, saying: 2 Speak unto Aaron and to his sons, that they separate
themselves from the holy things of the children of Israel, which they hallow
unto Me, and that they profane not My holy name: I am the LORD. 3 Say
unto them: Whosoever he be of all your seed throughout your generations, that
approaches unto the holy things, which the children of Israel hallow unto the
LORD, having his uncleanness upon him, that soul shall be cut off from before
Me: I am the LORD.
A non-Cohain is considered in our case a Stranger and would
get Kares for doing the work/service of a Cohain.
4 What
man soever of the seed of Aaron is a leper, or hath an issue, he shall not eat
of the holy things, until he be clean. And whoso touches any one that is
unclean by the dead; or from whomsoever the flow of seed goes
out; 5 or whosoever touches any swarming thing, whereby he may be
made unclean, or a man of whom he may take uncleanness, whatsoever uncleanness
he hath; 6 the soul that touches any such shall be unclean until the
even, and shall not eat of the holy things, unless he bathe his flesh in
water. 7 And when the sun is down, he shall be clean; and afterward
he may eat of the holy things, because it is his bread.
The Cohain has to be Tahor (ritually pure) to receive Teruma,
sacrifice the Korban or eat the Korban so the Purification in the Mikveh is
important.
8 That
which dies of itself, or is torn of beasts, he shall not eat to defile himself
therewith: I am the LORD.
But neither can a common Ben Yisrael eat Nevailah or Trafe.
9 They
shall therefore keep My charge, lest they bear sin for it, and die therein, if
they profane it: I am the LORD who sanctify them. 10 There shall no
common man eat of the holy thing; a tenant of a priest, or a hired servant,
shall not eat of the holy thing.
The famous story around Daf 33 in Shabbos about the non-Jew
who wanted to become Cohain Gadol that came to Hillel. Hillel accepted him as a
candidate for conversion. Hillel told him to learn the laws for being the High
Priest. When he got to this Pasuk that a stranger can’t eat a holy thing, he
released that he could never be the Cohain Gadol or wear the wonderful garments
but he fell in love with Judaism by this time and blessed Hillel for accepting
him.
11 But
if a priest buy any soul, the purchase of his money, he may eat of it; and such
as are born in his house, they may eat of his bread.
Since the Cohain’s slave is his property, he may eat from the
Cohain.
12 And
if a priest's daughter be married unto a common man, she shall not eat of that
which is set apart from the holy things.
The Cohain’s daughter when she is in his house
can eat Teruma.
13 But
if a priest's daughter be a widow, or divorced, and have no child, and is
returned unto her father's house, as in her youth, she may eat of her father's
bread; but there shall no common man eat thereof.
The widow part here appears that she can eat from
her children. It appears that she can similar to a Bas Cohain, but it is not
written.
14 And
if a man eat of the holy thing through error, then he shall put the fifth part
thereof unto it, and shall give unto the priest the holy thing.
B’ Mayzid (willingly) he would get Kares, B’De-avad (by
accident or accidently) in that he thought it was his part from his Korban and
not the Cohain’s Portion or Korbanos got mixed up though lack of caution on his
part.
15 And
they shall not profane the holy things of the children of Israel, which they
set apart unto the LORD; 16 and so cause them to bear the iniquity
that bringeth guilt, when they eat their holy things; for I am the LORD who
sanctify them.
Therefore, Cohanim have to be extra-careful and diligent in
performing their duties in the Mikdash with Korbanos and even with Teruma.
17 And
the LORD spoke unto Moses, saying: 18 Speak unto Aaron, and to his
sons, and unto all the children of Israel, and say unto them: Whosoever he be
of the house of Israel, or of the strangers in Israel, that bringeth his
offering, whether it be any of their vows, or any of their free-will-offerings,
which are brought unto the LORD for a burnt-offering; 19 that ye may
be accepted, ye shall offer a male without blemish, of the beeves, of the
sheep, or of the goats. 20 But whatsoever hath a blemish, that shall
ye not bring; for it shall not be acceptable for you.
An ordinary person brings a Korban. He is no expert on these
animals. He might be a city slicker or even a country bumkin who does not know
a ripped ear, blind eye or lame leg makes the Korban blemished. So the Cohain
should inspect the Korban to make sure that what he accepts has no blemish. A
blemished is called in Hebrew a Mum. An expert in animals (also in modern
Hebrew a specialist is a Mumher).
21 And
whosoever brings a sacrifice of peace-offerings unto the LORD in fulfilment of
a vow clearly uttered, or for a freewill-offering, of the herd or of the flock,
it shall be perfect to be accepted; there shall be no blemish
therein. 22 Blind, or broken, or maimed, or having a wen, or scabbed,
or scurvy, ye shall not offer these unto the LORD, nor make an offering by fire
of them upon the altar unto the LORD. 23 Either a bullock or a lamb
that hath anything too long or too short, that mayest thou offer for a
freewill-offering; but for a vow it shall not be accepted. 24 That
which hath its stones bruised, or crushed, or torn, or cut, ye shall not offer
unto the LORD; neither shall ye do thus in your land.
This is the list of blemishes that the Cohain has to look out
for.
25 Neither
from the hand of a foreigner shall ye offer the bread of your God of any of
these, because their corruption is in them, there is a blemish in them; they
shall not be accepted for you.
Today the man or woman is a non-Jew and their meal offering
is forbidden. Later in the day, the man or woman converts and goes to the
Mikvah. At this point the individual is a Jew in all ways and can bring bread.
(Probably, would have to take new flour.)
26 And
the LORD spoke unto Moses, saying: 27 When a bullock, or a sheep, or
a goat, is brought forth, then it shall be seven days under the dam; but from
the eighth day and thenceforth it may be accepted for an offering made by fire
unto the LORD.
There is a minimum time of living for an animal to brought
for a Korban.
28 And
whether it be cow or ewe, ye shall not kill it and its young both in one day.
It would be cruelty.
29 And
when ye sacrifice a sacrifice of thanksgiving unto the LORD, ye shall sacrifice
it that ye may be accepted. 30 On the same day it shall be eaten; ye
shall leave none of it until the morning: I am the LORD. 31 And ye
shall keep My commandments, and do them: I am the LORD.
In case you did not know why you keep the commandments as
instructed the you are woken up by one fact: I am the L-RD.
32 And
ye shall not profane My holy name; but I will be hallowed among the children of
Israel: I am the LORD who hallow you, 33 that brought you out of the
land of Egypt, to be your God: I am the LORD.
One is not allowed to make a Hillul (profane) HASHEM only a
Kiddush HASHEM.
23:1
And the LORD spoke unto Moses, saying: 2 Speak unto the children of
Israel, and say unto them: The appointed seasons of the LORD, which ye shall
proclaim to be holy convocations, even these are My appointed seasons.
Speak to the children of Israel…The Lord’s
appointed [holy days]: Designate
the [times] of the festivals so that [all of] Israel will become accustomed to
them, [meaning] that they should proclaim leap years for [the Jews in] the
Diaspora who had uprooted themselves from their place to ascend to [Jerusalem
for] the festivals, but who had not yet arrived in Jerusalem. [The leap year
would enable them to arrive in time. Consequently, in ensuing years, they would
not lose hope of arriving on time and would be encouraged to make the
pilgrimage.]- [Toras Kohanim 23:139; Levush
Ha’orah. See also Mizrachi , Nachalath Ya’akov , Sefer Hazikkaron , Yosef Hallel , Chavel]

Six days shall work be done; but on the seventh day is a sabbath of solemn
rest, a holy convocation; ye shall do no manner of work; it is a sabbath unto
the LORD in all your dwellings.
We have finished dealing with the holiness of the nation, the
Cohanim and the Korbanos. Now we move on to the holiness of the days. The holy
of holies is Shabbos and that starts out our holy days.
[For] six days…: Why does the Sabbath [designated by God,] appear here amidst
the festivals [designated by the Sanhedrin]? To teach you that whoever
desecrates the festivals is considered [to have transgressed as severely] as if
he had desecrated the Sabbath, and that one who fulfills the festivals is
considered as if he has fulfilled the Sabbath, [and his reward is as great]. —
[Be’er Basadeh; Toras Kohanim 23:144]
4. These
are the appointed seasons of the LORD, even holy convocations, which ye shall
proclaim in their appointed season.
We start off with two of the three Regelim (where one goes up
by foot). Then we will continue with Rosh Hashanah and Yom Kippur and return
for Sukkos. The only holiday mentioned by its current name is Pesach. The Torah
has other names for Shavuos and Sukkos.
5 In
the first month, on the fourteenth day of the month at dusk, is the LORD'S Passover. 6 And
on the fifteenth day of the same month is the feast of unleavened bread unto
the LORD; seven days ye shall eat unleavened bread. 7 In the first
day ye shall have a holy convocation; ye shall do no manner of servile
work. 8 And ye shall bring an offering made by fire unto the LORD
seven days; in the seventh day is a holy convocation; ye shall do no manner of
servile work.
Pesach lasts seven days. The first day is a Yom Tov and the
last but it is one continuous festival. Like Shabbos on Yom Tov one should not
do Melacha. The exceptions are carrying in between a private and public domain
and cooking for the Chag. The emphasis is cooking for the Chag but not longer.
Left-overs are not forbidden but should not be done on purpose. If Shabbos
falls after a Yom Tov, we make an Eruv Tavshillin for cooking from Yom Tov for
Shabbos. (See either Kitzur Shulchan Aruch or close to the end of Mishnah
Berurah Volume Hay about Hebrew Page 297)
9 And
the LORD spoke unto Moses saying: 10 Speak unto the children of
Israel, and say unto them: When ye are come into the land which I give unto
you, and shall reap the harvest thereof, then ye shall bring the sheaf of the
first-fruits of your harvest unto the priest.
This is the Omer.
[you shall bring…an Omer] of the beginning of
your reaping: the first
of the harvest [from the fields. Thus, one is permitted to proceed with the
general harvest only after this Omer has been reaped.]- [Sifthei
Chachamim; Men. 71a] Omer: a tenth of an ephah (see Exod. 16:36). That was its [the measure’s] name, like “And they measured
it with an Omer” (Exod. 16:18).
11 And
he shall wave the sheaf before the LORD, to be accepted for you; on the morrow
after the sabbath the priest shall wave it. 12 And in the day when ye
wave the sheaf, ye shall offer a he-lamb without blemish of the first year for
a burnt-offering unto the LORD. 13 And the meal-offering thereof
shall be two tenth parts of an ephah of fine flour mingled with oil, an
offering made by fire unto the LORD for a sweet savor; and the drink-offering
thereof shall be of wine, the fourth part of a hin. 14 And ye shall
eat neither bread, nor parched corn, nor fresh ears, until this selfsame day,
until ye have brought the offering of your God; it is a statute forever
throughout your generations in all your dwellings.
This is Korban-wise what is done in the
Mishkan-Mikdash. The silver platter carrying the fruit and arrangement is
described in Mishnayos Bikkurim.
15 And
ye shall count unto you from the morrow after the day of rest, from the day
that ye brought the sheaf of the waving; seven weeks shall there be
complete; 16 even unto the morrow after the seventh week shall ye
number fifty days; and ye shall present a new meal-offering unto the
LORD.
Chag Shavuos is determined by counting seven full week aka 49
full days and on the 50th day is the Chag. So somewhere between day
42 and day 45 people began preparing for their journey to Yerushalayim.
17 Ye
shall bring out of your dwellings two wave-loaves of two tenth parts of an
ephah; they shall be of fine flour, they shall be baked with leaven, for
first-fruits unto the LORD. 18 And ye shall present with the bread
seven lambs without blemish of the first year, and one young bullock, and two
rams; they shall be a burnt-offering unto the LORD, with their meal-offering,
and their drink-offerings, even an offering made by fire, of a sweet savor unto
the LORD. 19 And ye shall offer one he-goat for a sin-offering, and
two he-lambs of the first year for a sacrifice of
peace-offerings. 20 And the priest shall wave them with the bread of
the first-fruits for a wave-offering before the LORD, with the two lambs; they
shall be holy to the LORD for the priest. 21 And ye shall make
proclamation on the selfsame day; there shall be a holy convocation unto you;
ye shall do no manner of servile work; it is a statute forever in all your
dwellings throughout your generations.
The first reaping of barley and then wheat began on the first
day of Chol HaMoed Pesach. That is one day in the Omer.
22
And when ye reap the harvest of your land, thou shalt not wholly reap the
corner of thy field, neither shalt thou gather the gleaning of thy harvest;
thou shalt leave them for the poor, and for the stranger: I am the LORD your
God.
Megillah Ruth is very appropriate for reading because of this
and it occurred at this time of year. Shavuos becomes the second of three Regelim.
23 And
the LORD spoke unto Moses, saying: 24 Speak unto the children of
Israel, saying: In the seventh month, in the first day of the month, shall be a
solemn rest unto you, a memorial proclaimed with the blast of horns, a holy
convocation. 25 Ye shall do no manner of servile work; and ye shall
bring an offering made by fire unto the LORD.
Rosh Hashanah is a solemn day indeed but nothing more than the
blasting of the Shofar is stated here.
26 And
the LORD spoke unto Moses, saying: 27 Howbeit on the tenth day of
this seventh month is the day of atonement; there shall be a holy convocation
unto you, and ye shall afflict your souls; and ye shall bring an offering made
by fire unto the LORD. 28 And ye shall do no manner of work in that
same day; for it is a day of atonement, to make atonement for you before the LORD
your God. 29 For whatsoever soul it be that shall not be afflicted in
that same day, he shall be cut off from his people.
What constitutes affliction. Our Rabbis determined five things.
Not bathing, eating, drinking, wearing leather shoes or marital relations.
30 And
whatsoever soul it be that does any manner of work in that same day, that soul
will I destroy from among his people. 31 Ye shall do no manner of
work; it is a statute forever throughout your generations in all your
dwellings. 32 It shall be unto you a sabbath of solemn rest, and ye
shall afflict your souls; in the ninth day of the month at even, from even unto
even, shall ye keep your sabbath.
Yom Kippur has a status similar to Shabbos.
33 And
the LORD spoke unto Moses, saying: 34 Speak unto the children of
Israel, saying: On the fifteenth day of this seventh month is the feast of
tabernacles for seven days unto the LORD.
The third of the three Regelim is Sukkos and making the
Tabernacle. Building and living in a Sukkah. Some disabled people upon reaching
my age no longer construct a Sukkah. I am lucky in that my forester son and
grandchildren aid me in setting up the Sukkah, putting up the Bamboo Shach as
the roof. If one is in danger of catching a cold like in northern climates, one
should try to eat in the Sukkah but if the climate is so cold, snowing, raining,
mosquitoes and other problems then one becomes exempt from sleeping. If one can
take a ‘cat nap’ then one should try. Rain, sandstorm, soot and other unpleasantness
exempts one from the Sukkah and in many places, Sukkos have to be tied down or
heavy boards placed on the Shach because of the wind.
35 On
the first day shall be a holy convocation; ye shall do no manner of servile
work.
This is the Yom Tov of the Holiday and the Lulav and Esrog
are brought (mentioned later on in the Torah).
36 Seven
days ye shall bring an offering made by fire unto the LORD; on the eighth day
shall be a holy convocation unto you; and ye shall bring an offering made by
fire unto the LORD; it is a day of solemn assembly; ye shall do no manner of
servile work.
Unlike the ending of Pesach that is the ending of the Chag,
this is a special Chag within itself and one gets to make a blessing of “reaching
this season” aka Shechehiyanu.
37 These
are the appointed seasons of the LORD, which ye shall proclaim to be holy
convocations, to bring an offering made by fire unto the LORD, a
burnt-offering, and a meal-offering, a sacrifice, and drink-offerings, each on
its own day; 38 beside the sabbaths of the LORD, and beside your
gifts, and beside all your vows, and beside all your freewill-offerings, which
ye give unto the LORD.
The next few Pasukim are describing the gathering of the last
Bikkurim such as late grapes from the mountains of Chevron, Dates, Pomegranates,
Olives and Figs. The four species of Lulav and Esrog are mentioned.
39 Howbeit
on the fifteenth day of the seventh month, when ye have gathered in the fruits
of the land, ye shall keep the feast of the LORD seven days; on the first day
shall be a solemn rest, and on the eighth day shall be a solemn
rest. 40 And ye shall take you on the first day the fruit of goodly
trees, branches of palm-trees, and boughs of thick trees, and willows of the
brook, and ye shall rejoice before the LORD your God seven days.
Hadas (myrtle) is a thick bush but the Esrog is
not mentioned as such but as a goodly tree Hadar. The trees called Hadar are Oranges,
Lemons, Grapefruits, etc. But most likely naturally occurring in Eretz Yisrael
is the Esrog.
41 And
ye shall keep it a feast unto the LORD seven days in the year; it is a statute forever
in your generations; ye shall keep it in the seventh month. 42 Ye
shall dwell in booths seven days; all that are home-born in Israel shall dwell
in booths;
These Sukkos are reminder of temporary structures in the
Midbar (wilderness) on the way to Eretz Yisrael. They most likely were put
together on wagons carrying the family to Yerushalayim for the Chag with their
sacrifice for the 8 days of the festival.
43 that
your generations may know that I made the children of Israel to dwell in
booths, when I brought them out of the land of Egypt: I am the LORD your God. 44 And
Moses declared unto the children of Israel the appointed seasons of the LORD.
The naming of Shabbos and Yom Tov ends now and the Torah
continues with the Mishkan.
24:1
And the LORD spoke unto Moses,
saying: 2 'Command the children of Israel, that they bring unto thee
pure olive oil beaten for the light, to cause a lamp to burn continually.
The eternal flame or Ner Tamid is to burn in the Mishkan and
later in the Mikdash.
3 Without the veil of the testimony, in the tent of
meeting, shall Aaron order it from evening to morning before the LORD
continually; it shall be a statute forever throughout your
generations. 4 He shall order the lamps upon the pure candlestick
before the LORD continually.
The flame on the Menorah shall not go out.
5 And thou shalt take fine flour, and bake twelve cakes
thereof: two tenth parts of an ephah shall be in one cake. 6 And thou
shalt set them in two rows, six in a row, upon the pure table before the
LORD. 7 And thou shalt put pure frankincense with each row, that it
may be to the bread for a memorial-part, even an offering made by fire unto the
LORD. 8 Every sabbath day he shall set it in order before the LORD
continually; it is from the children of Israel, an everlasting covenant. 9 And
it shall be for Aaron and his sons; and they shall eat it in a holy place; for
it is most holy unto him of the offerings of the LORD made by fire, a perpetual
due.'
This is the Shewbread.
10 And the son of an Israelitish woman, whose father was an
Egyptian, went out among the children of Israel; and the son of the Israelitish
woman and a man of Israel strove together in the camp. 11 And the son of the
Israelitish woman blasphemed the Name, and cursed; and they brought him unto
Moses. And his mother's name was Shelomith, the daughter of Dibri, of the tribe
of Dan.
He was a ben Yisrael but was only with the tribe of Dan by
his mother but it was a mixed marriage with an Egyptian who apparently had not
converted and had no fear of G-D.
In Sanhedrin it states that he used NAME like Yose should

It does not matter if it is a non-Yisrael or Ben Yisrael that
blasphemes that person(s) shall die.

If there are no witnesses or the murderer was not warned to
cease and desist by witnesses there are options for the government to take care
of those dangerous to society vs. a heat of passion murder.
19 And if a man maim his neighbor; as he hath done, so
shall it be done to him: 20 breach for breach, eye for eye, tooth for
tooth; as he hath maimed a man, so shall it be rendered unto
him. 21 And he that kills a beast shall make it good; and he that

Unarmed and against
Hamas on Oct. 7th by Rachamim Pauli
There was one man who stood alone at the entrance to a public shelter
in the perihelial of Gaza. Hamas was on the ground and shooting and lobbying
grenades towards the shelter. 7 times they threw a grenade and 7 times he caught
them and pitched them back. But the eight time, he died on a Kiddush HASHEM. Only
after that did the cowards come with their automatic weapons and spray the
shelter with bullets. One of the survivors was a woman who played dead with
wounded on top and survived to tell the story. This was written months ago.
Not so far away there was another shelter. Retired General Dan
Simchi tells the story of his son Guy. Guy was at the Nova Party unarmed. He
was a paratrooper officer. He and a friend with an automatic weapon stood guard
at the entrance of the shelter. The reasoning was if the armed guardian was
hit, Guy would take his place. The terrorists came some close that Guy managed
to kill at least one with his bare hands. Somehow the two managed to keep the
terrorists from murdered the people inside but Guy HY”D was not that lucky and
died on a Kiddush HASHEM.

Note: In 2009 I filed a news story
about a Chasidic kidney donator in my "Future" folder. This week I
finally decided to use it. While editing it one last time, I thought to google
him in the hope to see his current health status. To my total astonishment, I discovered
that in 2019, he had donated again-this time a part of his liver!! So: on to
the old story and then to the newer!
Part A: The Kidney
"It's not like I woke up one morning and wanted to donate a kidney,"
said Simon, who serves as the Chabad Rabbi in Teaneck, New Jersey. "My own
children, ages 2 to 14, are my first priority."
He recounted how a woman named Chaya Lipshutz in Tsfat, Israel, had been
posting for years on Teaneck Shuls about people who needed kidney donors.
"I would read them, and sigh, and go on with my day. I have nine little
children and it was not something I would envision doing." However, one
such posting touched him deeply. "In August 2008, Lipshutz posted about a
12-year-old girl - how could I let a 12-year-old girl die? I have a daughter
who is 12.
"I spoke to my wife about it. We discussed it intensely; we could not let
a 12-year-old girl die." When he called a few days later to offer to test
for the youngster, the need had already been met.
"My wife was very relieved. But I felt if I could do this for her, I could
do it for someone else in a similar situation." He was tested as a donor
for the next two postings, a 40-year-old mother of two and a 30-year-old male,
but he did not match. "OK," he thought. "I can't give this kidney
away."
Then, in the spring of 2009, Simon, 41, learned of a 51-year-old father of 10
who desperately needed a kidney [and who asks that his name be withheld].
"After Purim I was tested. About one hour before the Passover Seder I got
a call from the hospital: 'Rabbi Simon, you match.'
"Since I'm a Chabad rabbi, in the summer we have children’s summer camp to
run. I asked if it was OK to wait until after camp ends."
Camp ended on Aug. 7, and the following week the two surgeries were performed
at New York-Presbyterian Hospital/ Weill Cornell Medical Center.
"Eighty thousand people need kidneys. The amount of people willing to
donate is not that many," said Simon. "Live kidneys from living
donors are healthier, and last longer."
Lipshutz states in her postings that "99 percent of the time there are no
complications for the donor. As for the recipient, there's about a 5 percent
chance that the kidney will fail."
Simon explained that he did extensive research. "There are risks," he
said, "but they are minimal. A donor will go through life with one kidney,
but you have plenty of kidney function with one kidney to live a long, healthy
life.
"If I put on a scale the risks and rewards, and I can save a human being,
and give a father of 10 back to his children and a husband back to his wife,
that reward outweighs the risk," said Simon. "I can't live my life
afraid of tiny risks. Every time we get in a car we take risks. It is such a
small risk to save a life."
Simon reported that in the process of screening you are asked if you are
getting any money to be a donor. "I responded that I wouldn't sell this
mitzvah for anything in the world. My two motivations were to save his life and
be an example for my children," he said.
"My younger ones don't completely understand. The older ones said, 'Wow,
that's amazing.' The real hero in all this is my wife, Nechama. She has been
very supportive from the minute I came to her about the 12-year-old girl. For
my wife it's a much bigger sacrifice. When you have nine children you need both
parents hands-on. I live to make life easier for my wife and this will
temporarily not make life easier for her."
A major goal of Simon's was the lesson he could provide for others. He was
disturbed by the recent scandal involving Jews in New Jersey selling kidneys.
"I hope that my operation taking place at the same time will show that
there are good people as well, and it will be a kiddush HaShem [sanctification
of G-d's name].
"I'm a rabbi and I teach my congregation and children how important it is
to give," he continued. "G-d put us here to help others.... My
children should see what it means to be a Jew and to sacrifice for others. I
told my older children, 'You all are one of my main motivations for doing that,
so that you should have an example.'
"The rabbi's greatest sermon is the way he lives his life," said
Simon.
"The kidney started working right on the operating table for him. In 48
hours he had completely normal kidney function," Simon reported. "It
was just an amazing experience, right up there with the birth of my nine
children," said Simon. "Here's a man who was dying and now he's a
healthy man. It's so rewarding to see that and to see the looks on his and his
wife's faces. They said, 'What can we say? What is thank you? It doesn't begin
to touch the surface.'
"I told him, 'Thank you for giving me this wonderful opportunity,'"
said Simon. "I really feel that way. I don't want him or his wife to feel
any obligation. It's my incredible honor. He shouldn't feel that he owes me
anything ever. G-d could have just as easily made me the recipient."
Lawrence Milstein, a Teaneck resident who attends a class offered by Simon,
said that the rabbi's deed has inspired others in the community. "We have
all in certain situations turned to each other and said, 'If Rabbi Simon can
donate his kidney, I can at least do such and such.' For some it is stretching
to give more time and or money to worthy causes at a time when we are all
feeling the economic pinch, or it is committing to being a better parent,
spouse, or friend...We are certainly taking other actions in our own lives to
make a positive impact."
Part B: The liver
What do you say to the person who has chosen to save your life? For their
initial phone call, Adam Levitz wracked his brain for the right words
to offer Chabad Rabbi Ephraim Simon, a man he had never met but was
willing to donate him a portion of his liver.
Levitz, who turned 45 in January, was battling death due to a rare autoimmune
disease, "primary sclerosing cholangitis" (PSC), that was slowly
destroying his own liver.
"I wanted to call him, but how do you start that conversation? Saying
thank you doesn't seem enough," states Levitz, who lives in Long Island,
New York with his wife and three children. "Especially since he had given
so much already."
A New Jersey resident, Simon - age 50, married and the father of nine - donated
a kidney in 2009 to another stranger in need. If he were to donate a lobe of
his liver, he would be one of a handful of people in the United States who are
dual living-organ donors - and the fourth to do so at Cleveland Clinic.
Getting to that point was a
six-year ordeal for Simon. Just three years after his kidney donation, he felt
a calling to give a portion of his liver, too.
"I was so grateful to be able to bring somebody back their health, to save
a human life," he explains. "I wanted that opportunity again. My
biggest challenge was finding a hospital that would accept me."
According to Federico Aucejo, MD, liver surgeon and surgical director of
the Liver Cancer Program, most centers refuse to accept
previous kidney donors as liver donors because they consider it risky and too
much for one person to undergo.
"These are very special situations that must be considered on a
case-by-case basis," says Dr. Aucejo. "At Cleveland Clinic, we
carefully evaluate the donor's physical and psychological condition. Based on
his results, we found Simon to be both physically and psychologically fit. As a
result, we thought he could safely undergo the operation. Additionally, it was
decided for him to donate the left lobe of his liver which is traditionally a
safer operation as opposed to donating the right lobe."
Every day Levitz passed without a new liver, he grew weaker. Diagnosed at 15
with Crohn's disease, a chronic intestinal disorder, Levitz
experienced occasional flare-ups until his late thirties. "From time to
time, I would get severe stomach pain, fatigue, joint swelling," he
recalls. "But it would clear up with medication."
However, in 2017, as he was preparing for an operation, he became so ill the
surgery was cancelled due to PSC, an autoimmune disease that attacks the bile
ducts. Doctors advised he would need a liver transplant one day - a day that
came sooner than expected.
As Levitz's liver quickly deteriorated, he got sicker and weaker. Unable to
make the hour-long commute to his job as a credit manager, he stopped working
and focused solely on finding a liver. It can be a daunting task, as statistics
from the United Network for Organ Sharing show approximately
3,000 people die annually or become too sick while waiting to receive a liver
transplant.
Twice Levitz got the call from a Philadelphia transplant center that a liver
from a deceased donor was available, once in August and again in October 2018.
Each time, it was called off because the donor liver was not suitable for
transplant. "We were devastated," recalls Levitz. "I didn't know
how much time I would have if we didn't find one soon."
Desperate, he reached out to Chaya Lipschutz, a kidney donor and self-described
"kidney matchmaker" who pairs donors and recipients through her
nonprofit Kidney Mitzvah. "I figured it was a long shot, but
maybe she knew of someone who wanted to give a liver," Levitz explains.
"And she did."
That someone was Simon, who too had contacted Chaya in hopes of finding a recipient
for his liver and a transplant center willing to accept a previous organ donor.
Within weeks, the Cleveland Clinic Transplant Center determined Simon and
Levitz could safely endure a transplant, scheduled for December 20, 2018. Donna
Ferchill, RN, a living donor coordinator who Simon says "was like an angel
to us," played an essential role in arranging the logistics.
Donna also arranged their first face-to-face meeting, just weeks after their
initial phone call, on December 18, 2018. Having learned Simon, despite his New
Jersey roots, is a Cleveland Browns fan, Levitz presented him with a Browns
jersey, inscribed with his name and the number 18 - which holds special
significance in Judaism, as it corresponds to a Hebrew word meaning "life."
Levitz says Simon was overjoyed with the token of his appreciation. "He
said, 'This is the greatest gift I ever got.' I said, 'it's a shirt! I think
you're giving me the greatest gift.'"
The night before their surgeries, Simon texted Levitz a picture of him wearing
the jersey, and the message he would share each time they met: Adam, I'm 100%
in. You're going to get this liver.
Dr. Aucejo harvested the left lobe of Simon's liver in an operation that
typically lasts four to five hours; and his colleague, Koji Hashimoto, MD, PhD,
director of the Living Donor Liver Transplantation at
Cleveland Clinic, transplanted 32% of Simon's liver into Levitz, in an 8-hour
operation.
Adam got the transplant in a very timely fashion," notes Dr. Hashimoto.
"Unless he had a chance to receive a new liver in another two or three
months, he might not have been in condition to undergo surgery. Living donor
liver transplantation can save sick patients before they reach the point where
they are no longer a candidate for a liver transplant."
A month after the transplant, Simon is back at work in his New Jersey office.
Levitz returned home to New York, with a new lease on life.
"He's unbelievable," says Levitz, of his donor. "All he wants to
do is help people. It's amazing."
As for Simon, he is thankful to be blessed with good health: "Being a
donor is my way of thanking G-d that I can help bring a husband back to his
wife, a father back to his children. I'd do it again, tomorrow, if they would
let me."
